MINUTES
OF ZONING HEARING BOARD MEETING
The zoning
hearing board of Palmer
Township met on Tuesday, March 1, 2005 at 7:30 P.M. in the Palmer Memorial
Library, One Weller Place,
to hear the following appeals. In
attendance were Nick Noel III, zoning board solicitor, Charles Roseberry, board chairman and Cherie Kavanaugh,
board member, John A. Embardino, zoning officer, and
court reporter Ted Rewak. Board member Dan Caravetta
was absent. The Express Times was
represented for hearings 05-07 and 05-08.

7:30 P.M. Kevin Gray, 1350 Tatamy
Road, is seeking relief from sections 190-199 C (1) (a) [1] and 190-116 D, for
expansion of a non-conforming structure and front yard setbacks to build
additions onto an existing home in a PO/IP district.
Witnesses: Kevin Gray, Dean Fenstermaker.
A motion was
made by Cherie Kavanaugh and seconded by Charles Roseberry to grant setback relief as requested to rebuild
the residence with front yard setback no less than what presently exists. All were in favor.

7:40 P.M. Denise Aburto, 1007
Greenleaf Street, Easton, is seeking a special exception per section 190-199 F
(2), to change from one nonconforming use to another at 1235
Tatamy Road,
located in an LDR district.
Witnesses: Denise Aburto, Don
Lynch.
Charles Roseberry made a motion to approve the request for a
special exception as presented, providing the seven northernmost parking spaces
proposed in exhibit A-5, be eliminated, the existing sign which is to have a
lettering change is to be externally illuminated and lit during business hours
only, and a buffer zone of evergreens must be installed between the parking
area and residential uses to the south.
Any expansion of the business beyond what was presented will need future
zoning approvals. All state highway
occupancy permits and regulations to apply.
The motion was seconded by Cherie Kavanaugh,
with all in favor.

7:50 P.M. KNBT, Lehigh Valley, is seeking relief from
sections 190-184 A (4) (a) and (b), 190-174 B, and 190-161 D (1) pertaining to
wall sign area in excess of square footage allowed on a lot with multiple
commercial establishments, excessive free-standing signs and lighting and
contrast of illuminated signs in the Palmer Town Center in a GC district.

A motion was
made by Cherie Kavanaugh to approve three walls signs
as depicted in exhibits A-4, 39.375 square feet in area, A-5, 45.16 square feet
in area, and A-6, 13.75 square feet in area, and also approving a fourth color,
an approximate 3/8 inch strip of white outlining the bank logo, and denying the
freestanding sign depicted in exhibit A-3.
The motion was seconded by Charles Roseberry,
with all in
favor.

8:00 P.M. Richard Westergren
of Poyant Signs of Amherst, New Hampshire,
representing Aspen Dental, is seeking relief from section 190-184 A (4)(a) to
install wall signs in excess of square footage allowed on a lot with multiple
commercial establishments in the Palmer Town Center in a GC district.

A motion was
made by Charles Roseberry and seconded by Cherie Kavanaugh to approve the sign request as presented in
exhibit A-2 for a wall sign of 45 square feet, with all in favor.

8:10 P.M. Bartush Signs,
Inc., of Orwigsburg, PA, representing Holiday Hair, is seeking relief from
section 190-184 A (4) (a) to install wall signs in excess of square footage
allowed on a lot with multiple commercial establishments in the Palmer Town
Center in a GC district.
This hearing is
continued at the applicants request, to April 5,2005, due to
lack of documentation for standing to be heard.

8:20 P.M. Stowaway Self Storage V, LLC of North Branch
NJ, is seeking relief from section 190-126 F, requiring a 150-foot setback from
abutting residential lots at 2279 Corriere Road in a
PO/IP district.

On a motion by
Cherie Kavanaugh and seconded by Charles Roseberry, with all in favor, the request for relief of the
required 150 foot setback was denied.
Deliberation in
the matter of SBA Network Services, hearing 05-03, February 1, 2005, relative to the installation
of a commercial communications tower to be located at 2210
Corriere Road,
which was deferred due to lack of required documentation, will commence at the
conclusion of hearing 05-12.
With the
necessary documentation received on February
22, 2005, and entered as exhibit A-17, the hearing was
deemed closed at that time. Deliberation
took place, and Charles Roseberry made a motion to
approve the request for a communications tower with multiple users as
presented, with the tower being restricted to 140 feet in height, and a buffer
zone to be installed between the tower lease site and the residential use to
the southeast. The tower is to be
removed upon abandonment and the land returned to its original condition. The motion was seconded by Cherie Kavanaugh, with all in favor.
Having no
further business to discuss, the hearing was adjourned.
