MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Wednesday, May 4, 2005 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh and Daniel Caravetta, board members, John A. Embardino, zoning officer, and court reporter Ted Rewak. 

 

Deliberation in the following matters before the zoning hearing board were held on Tuesday, May 10, 2005, at 10:00 a.m. in the Palmer Memorial Library.

 

7:30 p.m.  SBA Network Services, Inc., Palmyra, N.J., will appear for clarification of a decision pursuant to a hearing on February 1, 2005, relative to the construction of a communications tower and accessory structures at 2210 Corriere Road, within a PIC district.

WITNESSES:  Eric Schock, Esq., Neil Nocete, radio frequency engineer for Sprint, Jim Scully, project manager with Velocitel, Inc. for Cingular, Allan Corpus, structural engineer from AMEC engineering.

A MOTION BY CHERIE KAVANAUGH WAS MADE TO AFFIRM THAT A DOUBLE ROW OF SCREENING AS PRESENTED ON THE ORIGINAL APPLICATION IS TO BE PROVIDED, AND THAT ENGINEERED CERTIFICATION OF THE TOWER COULD BE PROVIDED IN LETTER FORM AND THAT (2) 60”x50”x31” AND (2) 72”x35.4”x40” CABINETS AND (1) 12’x20’ SHED WITH A HEIGHT OF 8’ AS PRESENTED BE ALLOWED ON THE PAD SITE.  THE MOTION WAS SECONDED BY CHARLES ROSEBERRY AND AGREED BY A 2-0 VOTE.  DAN CARAVETTA DID NOT PARTICIPATE IN THIS DECISION.

 

05-20 7:40 p.m.  Jimmie Tomaino, 2413 Lawnherst Avenue is seeking a special exception for a home occupation per section 190-38 B, to operate a construction business in an MDR zone.

THIS HEARING APPLICATION WAS WITHDRAWN BY THE APPLICANT.

 

05-21                        7:50 p.m.  Carrie Nolan and Tracy Havlvorsen, 33 Babbling Brook Road, are seeking relief from section 190-194 B (4) (b), to keep a front yard deck in excess of the projection allowed into a front yard situated in an MDR zone.

WITNESSES:  Tracy Halvorsen, Carrie Nolan.

DANIEL CARAVETTA MADE A MOTION TO DENY A 12’ DEEP DECK AS PRESENTED BUT TO ALLOW AN 8’ DEEP DECK AT THE FULL WIDTH OF 26’ AS PRESENTED.  THIS MOTION WAS SECONDED BY CHERIE KAVANAUGH WITH ALL THREE BOARD MEMBERS IN AGREEMENT.


 

05-22                        8:00 p.m.  Howard Coley, 325 N. Nulton Avenue, is seeking a special exception for a home occupation per section 190-38 B, to operate a concrete staining and engraving business in an MDR zone.

WITNESSES: Howard Coley, Samuel Moretti, 216 Brentwood Avenue.

A MOTION WAS MADE BY CHERIE KAVANAUGH AND SECONDED BY DANIEL CARAVETTA TO GRANT THE HOME OCCUPATION WITH THE CONDITION THAT THE APPLICANT’S  TRAILER CONTAINING ADVERTISING AND ARTWORK MAY NOT BE PARKED IN THE RESIDENTIAL NEIGHBORHOOD.  ALL THREE BOARD MEMBERS WERE IN AGREEMENT.

 

05-23                        8:10 p.m.  Shari Svoboda, representing Apex Wireless, Inc. 833 S. 25th Street, is seeking relief from section 190-184 A (4) (a), to install wall signs in excess of area allowed on a lot with multiple commercial establishments in the Palmer Town Center, located in a GC district.

WITNESSES:  Shari Svoboda, Tammi Schuler

A MOTION WAS MADE BY DANIEL CARAVETTA TO APPROVE THE 48”x100” WALL SIGN ABOVE THE CANOPY AS PRESENTED AND THE NEON “OPEN” SIGN ABOVE THE DOOR AND ROTATING POSTER SIGNAGE, BUT TO ELIMINATE ALL NEON TUBING OUTLINING THE WINDOWS AND NOT ALLOW THE 4 LIGHT BOX SIGNS IN THE WINDOWS.  THIS MOTION WAS SECONDED BY CHERIE KAVANAUGH WITH ALL IN AGREEMENT.

 

05-24                        8:20 p.m.  Interstate Development Services, Inc. for Commerce Bank, of Mount Laurel, N.J., is seeking relief from sections 190-166 (table 17.1), 190-184 A (4) (a), and 190-184 B (4) (b), for deficient parking, wall signs and freestanding signs in excess allowed on a lot with multiple commercial establishments at the Palmer Park Mall, situated in a PC zone.

WITNESSES:  Timothy Siegried, Esq., Mike Jeitner of Bohler Engineering, Erwin Andres of Atlantic Traffic and Design, opposition witnesses John and Mildred Polomchak of 2930 Woodlawn Avenue.

CHERIE KAVANAUGH MADE A MOTION TO DENY THE APPLICATION FOR THE BANK LOCATION AS PRESENTED DUE TO PARKING DEFICIENCIES.   DANIEL CARAVETTA SECONDED THE MOTION WITH ALL IN AGREEMENT.  Signage issues were not addressed due to this decision.

 

05-25                        8:30 p.m.  Joseph M. Hogan, 1160 Whitehall Avenue, is seeking a special exception per section 190-38 C and a variance from 190-42 E (4), to construct an addition to his home for a conversion into an accessory apartment that will not meet the front yard setback requirements in an MDR zone.

WITNESSES:  Joseph and Kathleen Hogan, Raymond Merli, 1159 Merion Avenue.

DANIEL CARAVETTA MADE A MOTION TO DENY THE APPLICATION AS PRESENTED.  CHERIE KAVANAUGH SECONDED THE MOTION WITH ALL IN AGREEMENT.

Having no further business to discuss, the hearing was adjourned
