MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, June 7, 2005 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh and Daniel Caravetta, board members, John A. Embardino, zoning officer, and court reporter Ted Rewak.

 

A motion, made by Cherie Kavanaugh to approve the minutes of the May 4 zoning hearings was seconded by Daniel Caravetta, with all in favor.

 

05-26    7:30 p.m.  Richard Crawford of Bartush Signs, representing KNBT is seeking relief from sections 190-184 A (4) (a) and 190-174 B, to install a wall sign in excess of the number of colors permitted and area allowed on a lot containing more than one commercial establishment at 801 S. 25th Street in a GC zone.

WITNESSES:  TIMOTHY SIEGFRIED, ESQ., RICHARD CRAWFORD (Bartush Signs), BILL PETERSON (KNBT).

A motion was made by Daniel Caravetta to deny the application as requested, seconded by Cherie Kavanaugh, with all in agreement.

 

05-27    7:40 p.m.  Ho Ho Wok Chinese Restaurant, 829 S. 25th Street, is seeking relief from section 190-184 A (4) (a), to install a wall sign in excess of area allowed on a lot with more than one commercial establishment located in a GC zone.

WITNESSES:  JOHNNY FANG, (contractor/representative), PI CHANG CHEN (owner).

A motion was made by Cherie Kavanaugh to approve the 16.5 square foot wall sign and a 30-inch diameter round window sign as requested.  Daniel Caravetta seconded the motion, with all in agreement.

 

05-28    7:50 p.m.  Mike Dyer, Easton Centres, LLC, representing WAWA, is seeking relief from section 190-184 A (4) (a), to install wall signs in excess of area allowed on a lot with more than one commercial establishment at 631 S. 25th Street in a GC zone.

At the request of Kate Durso, Esq., this hearing was continued to July 6, 2005.  Attorney Durso waived the 60-day time limit for this continuance.

 

05-29    8:00 p.m.  Atul Patel, owner of Holiday Inn Express Hotel and Suites, 90 Kunkle Drive, is seeking relief of section 190-185 B (4), to install wall signage in excess of area allowed on a structure on a lot located in a PO/B zone.

WITNESSES:  MARK MALKAMES, ESQ., ALICE SHIELDS (general manager), MRS. TINA PATEL (co-owner).

A motion was made by Daniel Caravetta to grant this sign request.  Cherie Kavanaugh seconded the motion and all were in agreement.

 

05-30    8:10 p.m.  Jason Metzger, 2111 Hillcrest Drive, is seeking a special exception pursuant to section 190-38 B, to operate a lawn care business as a home occupation in a MDR zone.

WITNESSES:  JASON METZGER (owner)

Cherie Kavanaugh made a motion to approve this special exception including a 17 foot enclosed trailer with no advertising on it, allowed to be parked on the premises.  Daniel Caravetta seconded the motion with all in favor.

 

05-31    8:20 p.m.  Huong Tran, 332 Springfield Way, is seeking a special exception pursuant to section 190-38 B, to operate a one-chair hair salon as a home occupation in an MDR zone.

WITNESSES:  HUONG TRAN (owner), VANCE PHEIFFER, 338 Springfield Way, JEAN GRIMSBY, 337 Springfield Way, NOVIE SOLUTA, 320 Springfield Way.

A motion was made by Dan Caravetta to approve this special exception as a one-chair owner operated, appointment only hair salon, with no more than 6 customers per day and no customer parking on the public street.  Cherie Kavanaugh seconded the motion, with all in favor.

 

05-32    8:30 p.m.  Michael Tate 804 Sheridan Drive, is seeking a special exception pursuant to section 190-38 B, to operate an Internet gun sales business as a home occupation in an MDR zone.

WITNESSES:  MICHAEL AND ELIZABETH TATE (owners)

A motion was made by Cherie Kavanaugh and seconded by Daniel Caravetta to deny this special exception, with all in agreement.

 

05-33    8:40 p.m.  Angelo Trinchere, 3030 Hecktown Road, is seeking relief of side yard setbacks pursuant to section 190-42 F (1), to construct an addition to his home in an MDR zone.

WITNESSES:  ANGELO TRINCHERE

A motion to approve this variance was made by Daniel Caravetta with the condition that the southwest corner of the home may be squared off with no further encroachment into the side and rear yards than the limits of the present west and southern walls of the home.  Cherie Kavanaugh seconded this motion, with all in agreement.
