MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Wednesday, July 6, 2005 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh and Daniel Caravetta, board members, John A. Embardino, zoning officer, Margaret Kennedy and Robert Gibbons, alternates, and court reporter Ted Rewak.

 

A motion to accept the minutes of the June 7, 2005 hearings was made by Cherie Kavanaugh, seconded by Daniel Caravetta, with all in favor.

 

05-26 7:30 p.m. Catherine Durso, Esq., representing Wawa Inc., is seeking relief from section 190-184 A (4) (a), to install wall signs in excess of area allowed on a lot with more than one commercial establishment, 190-161 D (1) & (3) and 190-174 B to exceed illumination and color limitations of signs, 190-183 A & B, restricting height of signs at 631 S. 25th Street in a GC zone. This hearing is continued from June 7, 2005.

WITNESSES:  Erich Schock, Esq., Scott Gerard, engineering manager for WAWA.

            Cherie Kavanaugh made a motion to grant a freestanding sign at 48 square feet in area, 11 feet high with four colors mounted on posts instead of a monument, along with a 25 square foot wall sign and 38 square foot goose wall relief logo and 6 canopy spanner signs with no other signage permitted.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

05-34 7:40 p.m. Edna Wegener, 18 Movie Court, is seeking relief from section 190 211 E (7) (c) [1], to erect a 6-foot high vinyl privacy fence within a required front yard setback in an MDR zone.

WITNESSES:  Paul and Edna Wegener.

            A motion to deny this request was made by Daniel Caravetta, seconded by Cherie Kavanaugh and all were in agreement.

 

05-35 7:50 p.m. Nic Zawarski & sons, Inc., 1441 Linden Street, Bethlehem, PA, is seeking relief from section 190-206 restricting business drive or accessways in a residential zone at Charlotte Avenue and Watson Street incorporating High Density Residential and Light Industrial districts.

WITNESSES:  James Preston, Esq., Martin Zawarski, vice-president Nic Zawarski and Sons, Bryan Ritter, civil engineer, Marcel and Shannon Van-Spanje, 2700 Charlotte Ave., Charles and Helen Villante, 2915 Charlotte Ave., Ronald Gower, 2903 Charlotte Ave., Margaret Zito, 2933 Charlotte Ave.

            A motion to grant this relief was made by Cherie Kavanaugh, seconded by Daniel Caravetta, with all in agreement.

 

05-36 8:00 p.m. Gwendolyn Dashner, 3422 Greenway Street, is seeking a variance from section 190-194 B (4) (b), to construct a front porch that will exceed the allowable encroachment into a required front yard in an MDR district.

            THIS VARIANCE RELIEF WAS WITHDRAWN AT THE APPLICANT’S REQUEST.

 

05-37 8:10 p.m. Mojdeh Tabatabaie, 417 Paxinosa Road, Easton, PA is seeking relief from section 190-33 E (2) to construct an enclosed entrance that encroaches front yard setback requirements along a minor arterial road at 3400 Nazareth Road in an MDR district.

WITNESSES:  Mojdeh Tabatabaie, Mehdi Tabatabaie.

            A motion to grant this relief was made by Daniel Caravetta, with the condition that the enclosure does not extend beyond the existing concrete porch platform.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

05-38 8:20 p.m. Gerald Lazarus, 1206 Dunkle Street is seeking relief from section 190-42 F (1) to construct an addition that would encroach upon side yard setback requirements in an MDR zone.

WITNESSES:  Gerard Lazarus, Brenda Hamm.

            A motion was made by Cherie Kavanaugh to grant relief from sideyard encroachment.  Daniel Caravetta seconded the motion and all were in agreement.

 

05-39 8:30 p.m. Thomas Edwards, of East Coast Signs Advertising, Inc., representing A. J. Wright, is seeking relief from section 190-184 A (4) (a) to erect wall signs in excess of area allowed on a lot with multiple commercial establishments at 785 S. 25th Street in a GC zone.

WITNESSES:  Bill Lockett, representing East Coast Signs.

          A motion was made by Daniel Caravetta to deny the request as presented, but to allow a wall sign with a maximum area of 150 square feet on the condition that proof of standing is supplied to the zoning board solicitor on July 7, 2005.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

          REVISION:  Due to lack of proof of ownership or other sufficient interest in the property to provide legal standing for this application, the application was denied.
