MINUTES OF ZONING HEARING BOARD MEETING

 

 

The zoning hearing board of Palmer Township met on Tuesday, August 2, 2005 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh and Daniel Caravetta, board members, Robert Gibbons, alternate, John A. Embardino, zoning officer, and court reporter Ted Rewak.

 

A motion, made by Daniel Caravetta to approve the minutes of the July 6 zoning hearings was seconded by Cherie Kavanaugh, and all were in favor.

 

05-40             7:30 p.m.  Verne Hahn, Nazareth PA, representing Michael and Linda Berardinucci, 203 Carbon Street, is seeking relief from sections 190-142 A (1), 190-42 C, and 190-199 C (2), to be granted a special exception to create a building lot lacking required density and depth in an MDR district.

WITNESSES:  TIMOTHY CHARLESWORTH, ESQ., VERNE HAHN, JAMES CHRISTMAN, PROJECT ENGINEER, MICHAEL BERARDINUCCI.

A motion to deny this special exception and variance was made by Cherie Kavanaugh and seconded by Daniel Caravetta, with all in agreement.

 

05-41            7:40 p.m.  Michael and Tanya Moussa, 2440 Woodridge Terrace, are seeking relief from section 190-168 D (1) (c), to construct a driveway not meeting setback requirements, and section 190-211 E (7) (d) [4], to retain a wall constructed in violation of setback requirements in an MDR district.

WITNESSES:  GARY BREWER, CONTRACTOR/FATHER-IN-LAW, MICHAEL AND TANYA MOUSSA, DANIEL FLYNN, 2448 EDGEMORE AVE. (O).

A motion by Daniel Caravetta was made to allow the existing wall to remain as is with no further extensions to be allowed, to allow a paved driveway to be constructed with a five-foot setback from the southern property line and this fiver-foot buffer to run the entire length of the driveway from the street entrance to the western terminus and this area to be returned to a grass lawn area, and to require the outlet of a drainpipe installed under the driveway and terminating onto Edgemore Avenue to be cut back so that the outlet terminates on the northern side of the driveway.  This motion was seconded by Cherie Kavanaugh, with all in agreement.

 

05-42            7:50 p.m.  Charles and Linda Massey, 1501 Blair Street, are seeking a variance pursuant to sections 190-42 A (1) and C, to create a building lot lacking the required area and depth in an MDR zone.

WITNESSES:  CHARLES, LINDA AND BRUCE MASSEY.

A motion to grant the variance for depth and area deficiencies of this 100’ x 115’ lot was made by Cherie Kavanaugh and seconded by Daniel Caravetta, with all in agreement.

 

05-43            8:00 p.m.  Arthur S. Gilmore, Pastor, First Baptist Church of Easton, 177 N. Greenwood Avenue, located in an MDR zone, is seeking a special exception per section 190-200 F (1), to retain a temporary modular classroom and a waiver of fees per section 190-200 F (2).

WITNESSES:  ARTHUR GILMORE, PASTOR.

A motion was made by Daniel Caravetta and seconded by Cherie Kavanaugh to allow the temporary classroom to remain for a 2-year extension of time, pursuant to the terms of a lease agreement, and to deny the waiver of zoning hearing fees.

 

Having no further business to discuss, the hearing was adjourned
