MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Wednesday, September 7, 2005 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh and Daniel Caravetta, board members, John A. Embardino, zoning officer, Margaret Kennedy, alternate, and court reporter Donna Kenderdine.

 

A motion to accept the minutes of the June 7, 2005 hearings was made by Cherie Kavanaugh, seconded by Daniel Caravetta, with all in favor.

 

05-44 7:30 p.m. William Lockett, East Coast Sign Inc., representing A.J. Wright, 785 S. 25th Street, is seeking relief from section 190-184 A (4) (a) to erect wall signs in excess of area allowed on a lot with multiple commercial establishments in a GC zone.

WITNESS:  WILLIAM LOCKETT.

CHERIE KAVANAUGH MADE A MOTION TO APPROVE A WALL SIGN WITH A MAXIMUM AREA OF 150 SQUARE FEET, 3 COLORS AND A TIMER TO TURN OFF ILLUMINATION OF SIGN AT 11 P.M.  THE MOTION WAS SECONDED BY DANIEL CARAVETTA, WITH ALL IN FAVOR.

05-45 7:40 p.m. Anthony and Lisa Gudzinas, 2664 Washington Street, are seeking relief from section 190-211 E (7) (d) [4], to construct a retaining wall not meeting setback requirements of an MDR zone.

WITNESSES:  BRIAN MONAHAN, ESQ., ANTHONY AND LISA GUDZINAS.

DANIEL CARAVETTA MADE A MOTION TO APPROVE THE APPLICATION AS REQUESTED WITH A ONE-FOOT SIDE YARD SETBACK.  THE MOTION WAS SECONDED BY CHERIE KAVANAUGH, WITH ALL IN FAVOR.

05-46      7:50 p.m. Lawrence Cioppi, 14 Howie Place, located in an LDR district, is seeking relief from setback requirements of 190-33 F (2), to place a shed 2 feet from a side property line.

WITNESS:  LAWRENCE CIOPPI.

A MOTION WAS MADE BY CHERIE KAVANAUGH TO DENY THE RELIEF REQUESTED, SECONDED BY DANIEL CARAVETTA, WITH ALL IN AGREEMENT.

05-47      8:00 p.m. Frank Gualano, 328 Elwood Street, located in an MDR district, is seeking relief from the requirements of 190-211 E (14) (a), to store a recreational vehicle in excess of 16 feet in length in a required front yard.

WITNESSES:  FRANK AND SHEILA GUALANO.

A MOTION WAS MADE BY DANIEL CARAVETTA TO DENY THIS REQUEST, SECONDED BY CHERIE KAVANAUGH, WITH ALL IN AGREEMENT.

05-48      8:10 p.m. Michael and Cathy Orchulli, 383 Arlington Street, located in an MDR district, are seeking a special exception pursuant to section 190-38 C, to convert a single family dwelling into a dwelling with an accessory apartment.

WITNESSES:  MICHAEL AND CATHY ORCHULLI.         

A MOTION WAS MADE BY CHERIE KAVANAUGH TO APPROVE THIS REQUEST WITH THE APARTMENT TO BE USED BY FAMILY MEMBERS ONLY, NOT TO BE USED AS A RENTAL UNIT.  THIS MOTION WAS SECONDED BY DANIEL CARAVETTA, WITH ALL IN FAVOR.

05-49        8:20 p.m.  Pete Christopoulos and Karen Quick, 2643 Eldridge Avenue, are seeking aggregate side yard setback relief from section 190-42 F (1), to construct an addition to their home in and MDR zone.

WITNESSES:  KAREN QUICK, ALEX QUICK, DON HILBERT, 1473 LAUREL LANE, MACUNGIE, PA.

A MOTION TO APPROVE THIS REQUEST WAS MADE BY DANIEL CARAVETTA WITH THE STIPULATION THAT AT LEAST 3 OFF-STREET PARKING SPACES BE PROVIDED PURSUANT TO PARKING REQUIREMENTS FOR RESIDENCES HAVING MORE THAN 4 BEDROOMS.  THIS MOTION WAS SECONDED BY CHERIE KAVANAUGH, WITH ALL IN FAVOR.

05-50        8:30 p.m.  Thomas Moskella, Jr., 4000 Freemansburg Avenue, is seeking relief from section 190-32 B (2) (a) to create new lots having less than 200-foot road frontage in an LDR zone.

A MOTION WAS MADE BY CHERIE KAVANAUGH TO GRANT THIS VARIANCE FOR LOT FRONTAGE ON A MINOR ARTERIAL ROAD WITH LESS THAN 200 FEET OF FRONTAGE.  THE MOTION WAS SECONDED BY DANIEL CARAVETTA, WITH ALL IN FAVOR.

05-51        8:40 p.m.  Ozzy Mamoor, Randolph, N.J., representing Jack’s Art Gallery, 765 S. 25th Street, is seeking relief from section 190-184 A (4) (a), to erect wall signs in excess of area allowed on a lot with multiple commercial establishments in a GC zone in the Palmer Town Center.

WITNESS:  OZZY MAMOOR.

A MOTION WAS MADE BY DANIEL CARAVETTA TO GRANT THIS WALL SIGN REQUEST AND REQUIRING A TIMER TO TURN OFF ILLUMINATION BY 11 P.M.  THE MOTION WAS SECONDED BY CHERIE KAVANAUGH, WITH ALL IN FAVOR.

05-52        8:50 p.m.  Andrew Wagner, of L & H Signs, Fleetwood PA, representing Citi Financial, 669 S. 25th Street, is seeking relief from section 190-184 A (4) (a), to erect wall signs in excess of area allowed on a lot with multiple commercial establishments in a GC zone in the Palmer Town Center.

WITNESS:  ANDREW WAGNER.

A MOTION WAS MADE BY CHERIE KAVANAUGH TO GRANT A WALL SIGN WITH A MAXIMUM AREA OF 31.94 SQUARE FEET AS REPRESENTED IN EXHIBIT A-4.  THE WALL SIGN LETTERING IS TO BE 18 INCHES HIGH AND A TIMER TO TURN OFF ILLUMINATION BY 11 P.M. SHALL BE PROVIDED.  THIS MOTION WAS SECONDED BY DANIEL CARAVETTA, WITH ALL IN FAVOR.
