MINUTES OF ZONING HEARING ON WEDNESDAY, JANUARY 7, 2004

 

The Zoning Hearing Board of Palmer Township met on Wednesday, January 7, 2004, at 7:30 p.m. in the meeting room of the Palmer Memorial Library.  In attendance were Chairman, Dan Caravetta, board members, Charles Roseberry and Cherie Kavanaugh, John Embardino, zoning officer, Ted Rewak, court reporter, and solicitor, Nicholas Noel, with no newspaper representative in attendance.

 

The minutes of the December 2, 2003 meeting were approved on a motion by Charles Roseberry, second by Cherie Kavanaugh, with all in agreement.

 

04-01    7:30 P.M.  Biagio Parascandolo, 4 Grove Street, Easton, PA, is seeking a special exception to continue or change an existing nonconforming use in an HI district to conduct a pizza restaurant business as per 190-199 B, with an alternative use variance from sections 190-112, 190-113, and 190-114.  He is also seeking relief from the William Penn overlay district requirements of sections 190-265, 190-266, 190-167 C, and relief from sign location restrictions of 190-180 C.

 

Witnesses:  Biagio Parascondolo, Ed Dietrich, and Louis Ferrone.

Charles Roseberry made a motion to approve the request to operate a pizza restaurant, citing that sections 190-112, 190-113, and 190-114 are not applicable subject to the zoning boards approval of a replacement of a nonconforming use as per 190-199 B, and that the requirements of 190-265 cannot be met due to the unique physical layout of the property, and should be waived, and that the requirements of 190-266 should be waived because earlier agreements for road frontage improvements were made between Palmer Township and the Palmer Town Center currently being developed.  Also, 190-167 C requirements are met as per parking capacities, and a sign, as presented in exhibit A-5, with a dimension of 12 feet by 3 feet, mounted on the mansard roof in front of the building be approved.

 

The motion was seconded by Cherie Kavanaugh and passed unanimously.

 

04-02    7:40 P.M. Pete Giacoumopoulos is seeking relief from sections 190-174 B, 190-180 B, and 190-184 (3) (a) to erect wall signs that exceed size, lighting and color requirements, on the City Diner at 1061 25th Street.

 

The 7:40 hearing for City Diner was postponed on request by Attorney Daniel Cohen, representing the applicant, until the February 3 hearing.

 

In other business, pursuant to the annual zoning board reorganizational meeting, Cherie Kavanaugh made a motion to retain Daniel Caravetta as chairman of the zoning hearing board with Charles Roseberry as second.  Motion passed by majority vote.

 

Having no further business to discuss, the hearing was adjourned.
