MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, May 4, 2004 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Dan Caravetta, board chairman, Charles Roseberry and Cherie Kavanaugh, board members, John A. Embardino, zoning officer, and the media was not represented.

 

 

04-02      7:30 P.M. Pete Giacoumopoulos is seeking relief from sections 190-174 B, 190-180 B, and 190-184 (3) (a) and reference to definitions in section 190-13, to erect wall signs that exceed size, lighting and color requirements, on the City Diner at 1061 25th Street, located in a GC zone.

WITNESSES:  Pete Giacoumopoulus, Daniel Cohen, Esq., Dave Backenstoe, Esq., John Embardino.

Motion by Charles Roseberry to deny request for variance as presented with the stipulation that the applicants may keep the wall sign on the front (main entrance) portion of building as presented, but must remove the wall sign on the southwest face of the building.  Second by Cherie Kavanaugh, with all in favor.

 

04-14   7:40 P.M.  Stella Misero of 1001 Milford Street is seeking a variance from  Sections 190-42 E (4) and 190-211 E (19) (d), to erect an above ground swimming pool on her premises in an MDR zone.

WITNESSES: Stella Misero, Brandi Hollander, Joseph Hollander.

A motion to grant the variance as requested was made by Cherie Kavanaugh, seconded by Charles Roseberry, with all in favor.

 

04-15       7:50 P.M.  Michael and Karen Barilone of 820 Stones Crossing Road are seeking a special exception, variance and interpretation of ordinances in reference to sections 190-37, 190-38, 190-40, 190-42 A (1), and 190-42 F, to erect a single family semi-detached home on a proposed subdivision in an MDR zone.

WITNESSES:  Don Frederickson, Michael Barilone, Ted Lewis, Esq.

A motion was made by Cherie Kavanaugh to approve the land for the development of a single family semi-detached structure with each unit having a minimum lot size of 15,000 square feet and to grant relief from the required 40 foot lot width at the street right of way for each of the lots.  Motion seconded by Charles Roseberry, with all in favor.

 

04-16       8:00 P.M.  Phillip Amato is seeking relief of section 190-262 B (1) to place a residence over a commercial use in excess of 1500 square feet in the William Penn overlay district.

WITNESSES:  Dr. Phillip Amato

On a motion by Charles Roseberry, seconded by Cherie Kavanaugh, with all in favor, relief was granted as requested.

 

04-17      8:10 P.M.  Robert Ferraro, 3276 Nazareth Road, is seeking relief from sections 190-210 C 15 and 190-42 I to place a residential apartment above a detached garage in a base MDR zone in the Nazareth Road overlay district.

WITNESSES: Robert Ferraro

Charles Roseberry made a motion to approve the apartment over the garage with the stipulation that all kitchen fixtures be removed upon sale of the premises and that the apartment may be used for family members only with no outside rental.  Motion was seconded by Cherie Kavanaugh with all in favor.

 

04-18      8:20 P.M.  RGC Development LP is seeking variances from sections 190-43 D 2 and 190-54 E 2 pertaining to area and bulk regulations and flexibility in placement of townhouses in a proposed gated community in an MDR zone.

WITNESSES:  Don Frederickson, Joel Wiener, Esq., Robert Ciccone, John Zawarski, Martin Gilchrist, Gary Hausman, James Kenney, Helen Gonzalez.

A motion by Cherie Kavanaugh to grant deminimus density and flexibility in placement request was seconded by Charles Roseberry, with all in favor.

 

 

Having no further business to discuss, the hearing was adjourned.
