MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, October 5, 2004 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Dan Caravetta, board chairman, Charles Roseberry and Cherie Kavanaugh, board members, John A. Embardino, zoning officer, Michael Shay, special solicitor, and court reporter Karen Mengel.  The media was not represented.

 

 

04-41      7:30 P.M.  John Dieser of LVG&C Management Corp., is seeking relief from section 190-184 A (3) for size and number of wall signs at a proposed Dairy Queen in the Palmer Town Center on 25th Street in a General Commercial zoning district.

WITNESSES:  Michael Jeitner P.E., John Deiser.

This hearing was continued to November 3, 2004 at the request of applicants.

 

04-42      7:40 P.M.  Keith Kensky, 3660 Timberlane Drive, is seeking relief from section      190-211 E (7)(b) and 190-194 C (1)(b), to erect a 4 foot high picket fence within the required sight triangle at the intersection of two local streets in an LDR district.

WITNESSES:  Mr. and Mrs. Keith Kensky, Steve Cyphers.

A motion to deny the application due to safety concerns was made by Charles Roseberry and seconded by Cherie Kavanaugh, with all voting in agreement.

 

04-43      7:50 P.M.  Michael Berardinucci, 203 Carbon Street, is seeking a special exception per section 190-199 C (2) to construct a home on a non-conforming lot of record and variances from sections 190-42 A (1), 190-42 B and 190-42 C for lot area, width and depth requirements in an MDR district.

WITNESSES:  Michael Berardinucci, Verne Hahn, Ann Krohl.

A motion to deny the request was made by Cherie Kavanaugh and seconded by Charles Roseberry, with all in agreement.

 

04-44      8:00 P.M.  James and Ellen Patten, 60 Jonathon Drive, are seeking a variance from side yard requirements of section 190-42 F (1), to construct an addition to the side of a semi-detached home in an MDR district. 

WITNESSES:  James and Ellen Patten.

Charles Roseberry motioned to approve the request as presented, seconded by Cherie Kavanaugh and all in agreement.

 

04-45      8:10 P.M.  Bruce C. Loch, 4905 Tilghman Street, Allentown, PA, is seeking variances from front yard and area requirements of sections 190-42 E (4) and 190-42 A (1) to construct a home on a lot of record at 2219 Gruver Avenue in an MDR district. 

WITNESSES:  Bruce Loch, William Malkames, Esq.

This hearing is continued to November 3, 2004, pending a review of slopes and water run-off.

04-46      8:20 P.M.  Francis J. Macklin, trading as Affinity Corp., is seeking variances for height, area, illumination and color limitations from sections 190-183, 190-184 A (3)(b)[1], 190-161 D (1) & (3), 190-267 C (1) & (3) and 190-174 B, to erect a sign in a base general commercial zone at 3361 William Penn Highway in the William Penn Highway overlay district.

WITNESSES:  Paul Harak, Esq.

This request was withdrawn by Mr. Harak.

04-47      8:30 P.M.  Joseph, Placido, and Robert Rizzolino are seeking a variance from section 190-33 A, to construct a single family residence on an undersized lot of record at 3301 Marwood Lane in an LDR zone.

WITNESSES:  Joseph Rizzolino, Dennis DeEsch, Esq., Jerry Zimmer, Sam Symia.  Solicitor Noel recused himself from this hearing and special solicitor Michael Shay filled in.

A motion was made by Cherie Kavanaugh to approve the request as presented providing that all setback requirements are met upon construction of a home.  The motion was seconded by Charles Roseberry with all in agreement.

 

Having no further business to discuss, the hearing was adjourned.
