MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Wednesday, November 3, 2004 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Dan Caravetta, board chairman, Charles Roseberry and Cherie Kavanaugh, board members, John A. Embardino, zoning officer, and court reporter Ted Rewak.  The media was not represented.

 

04-41      7:30 P.M.  John Dieser of LVG&C Management Corp., is seeking relief from section 190-184 A (3) for size and number of wall signs at a proposed Dairy Queen in the Palmer Town Center on 25th Street in a General Commercial zoning district. 

Witnesses:  Michael Jeitner, P.E., John Dieser, Jim Meinecke.

A first motion was made by Charles Roseberry, seconded by Cherie Kavanaugh, with all in agreement, to approve the signage as follows:  4 promo boards designated as 8Z and 8Y in exhibit A3 are to be removed.  Wall signage to be reduced to one 95 square foot and two 58 square foot signs, one per wall, to be placed on any three exterior walls of the applicant’s choosing. In addition, 1 freestanding menu board with an area of 38 square feet and one pre-menu board with an area of 13 square feet will be allowed along the northern drive thru lane as presented in exhibit A2.    All directional signage will comply with ordinance specifications.

A second motion was made by Charles Roseberry and seconded by Cherie Kavanaugh, with Caravetta and Roseberry in favor and Kavanaugh against, the motion passed to allow neon tubing on northern wall of the building only.  No tubing is to wrap around any corners of the building and must be of a deep blue color as indicated in exhibit A6 brochure.

 

04-45       7:40 P.M.  Bruce C. Loch, 4905 Tilghman Street, Allentown, PA, is seeking variances from front yard and area requirements of sections 190-42 E (4) and 190-42 A (1) to construct a home on a lot of record at 2219 Gruver Avenue in an MDR district. 

This hearing was continued to December 7.  A waiver on time limitations was received from Mr. Loch.

 

04-48      7:50 P.M.  Joseph Rizzolino, et al, are seeking a special exception per section 190-199 F to change an existing nonconforming warehouse and wholesale sales use in an MDR district to include retail sales areas and warehousing at 2250 Corriere Road.

Witnesses:  Joseph Rizzolino, Dennis DeEsch, Esq., Scott Desmond, Bob Fretz.

A motion was made by Cherie Kavanaugh, seconded by Charles Roseberry, with all in agreement to approve this request as presented for a change from one nonconforming use to two nonconforming uses consisting of a retail use for a pool supply business using the front 3000 square feet of the structure and a 15’ by 15’ fenced in outdoor display area as presented in exhibit A2.  The rear 3000 square feet of the structure is to be used for warehousing for the Palmer Nursery business located on the adjacent lot.

 

04-49      8:00 P.M.  John Bayer, 3215 Vermont Street, is seeking a variance to build a porch with a roof in excess of front yard encroachment and size allowances of section 190-194 B (4)(b) in an MDR zone.

Witnesses:  John and Faith Bayer.

A motion to approve this request was made by Charles Roseberry and seconded by Cherie Kavanaugh, with all in agreement, with the stipulation that the depth of the porch be reduced to five feet.

 

04-50      8:10 P.M.  Diane Brodsky, 3015 Clayton Street, is seeking a variance to convert an existing roofed concrete patio into a living area which does not meet rear yard setback requirements of section 190-42 G (1) in an MDR district. 

Witnesses:  Diane Brodsky.

A motion was made by Cherie Kavanaugh and seconded by Charles Roseberry, with all in agreement to approve the request as presented.

 

04-51      8:20 P.M.  Pete Giacoumopoulos, 104 Morrison Avenue, Easton is seeking a variance to install a cooler on the rear of Tic Tic Restaurant, 2510 Northampton Street, that will encroach upon rear yard setback requirements of section 190-82 F, in a General Commercial district.

Witnesses:  Don Frederickson, Pete Giacoumopoulos.

A motion was made by Cherie Kavanaugh, seconded by Charles Roseberry, with all in agreement, to approve the request as presented.

 

 

Having no further business to discuss, the hearing was adjourned.
