MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, December 7, 2004 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Dan Caravetta, board chairman, Charles Roseberry and Cherie Kavanaugh, board members, John A. Embardino, zoning officer, and court reporter Ted Rewak.  The media was not represented.

 

04-51                  7:30 P.M.  Robert and Jeanne Ferraro, 3276 Nazareth Road, are seeking a special exception, per section 190-38 B, to operate a home business involving the organization of athletic events and distribution of goods in a base Medium Density Residential district in the Route 248 Overlay District.

Witnesses:  Robert and Jeanne Ferraro

A motion was made by Cherie Kavanaugh to deny the application for a home occupation, and was seconded by Charles Roseberry with all in agreement.  The applicants must apply for a home conversion under article XXV.

 

04-52                  7:40 P.M.  Joseph Gerbino, 2528 Swanson Street, is seeking a variance from section 190-211 E (19) (d), requiring the placement of a pool in a side or rear yard only.  These premises are in a Medium Density Residential zone.

Witnesses:  Joseph Gerbino.

A motion to approve the application as presented was made by Charles Roseberry and seconded by Cherie Kavanaugh, with all in agreement.

 

04-53                  7:50 P.M.  Doug Kassay, 1149 Harrisburg Pike, Carlisle, PA, representing Giant Food Stores, LLC, is seeking a variance from section 190-184 A (4) (a), restricting area and location of wall signs on a lot with more than one commercial establishment in the Palmer Center located on 25th Street in a General Commercial district.

Witnesses:  Doug Kassay.

Cherie Kavanaugh made a motion to approve 2 canopy signs on faces of the canopy of the applicant’s choosing, and to eliminate signs on pumps and booth that reference “Giant”.  There may be signs on the gas pumps that indicate prices.  Charles Roseberry seconded the motion, with all in agreement.

 

04-54                  8:00 P.M.  Denise Aburto, is seeking a special exception per section 190-199 F (2), to change from one non-conforming use to another at 1235 Tatamy Road in a Medium Density Residential district.

An error was made in the district designation and the record corrected to show that the premises referenced in this hearing are in a Low Density Residential district.

Charles Roseberry made a motion to deny the application due to lack of sufficient information.  Cherie Kavanaugh seconded the motion, with all in agreement.

 

Having no further business to discuss, the hearing was adjourned.
