MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, May 2, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh, board member, and R. Margaret Kennedy, alternate filling in for Daniel Caravetta, John A. Embardino, zoning officer, and court reporter Ted Rewak.

 

A motion was made by Cherie Kavanaugh to accept the minutes of the April 4 zoning hearings.  R. Margaret Kennedy seconded the motion with all in agreement. 

 

06-17     7:30 p.m.  Robert Cahill of Cahill Properties, LLC, 60 W. Broad Street, Bethlehem, PA, is seeking relief from sections 190-166 A (1) and Table 17.1 setting parking requirements, and sections 190-168 D (1) and G (1) setting driveway design standards and setbacks for a proposed office building on a property located in a GC district at 3750 Nicholas Street, and owned by Atul and Hansa Kharecha.

WITNESSES:  DON FREDRICKSON, AND ROBERT CAHILL FOR THE APPLICANTS, AND JOHN MORELLO, OWNER OF MORELLO FUNERAL HOME, 3720 NICHOLAS STREET.

A motion was made by Cherie Kavanaugh to approve this request for relief from parking requirements for employees and to allow a common driveway subject to a binding easement agreement.  The motion was seconded by R. Margaret Kennedy, with all in agreement. 

06-18     7:40 p.m.  Susan Sos, 8 Kendon Drive, is seeking a special exception per section 190-38 B, to operate a home occupation for the assembly and distribution of quilts in an MDR district.

WITNESSES:  SUSAN AND JAMES SOS.

A motion was made by R. Margaret Kennedy to approve this special exception as requested.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

06-19     7:50 p.m.  Michael Moussa, 2440 Woodridge Terrace, is seeking relief from section 190-211 E (7) (d) [4] for the purpose of constructing a retaining wall that will not meet the setback requirements for height of the wall.  These premises are located in an MDR district.

WITNESSES:  MICHAEL MOUSSA AND GARY BREWER FOR THE APPLICANTS, AND DANIEL FLYNN 2448 EDGEMORE AVENUE.

A motion was made by Cherie Kavanaugh, and seconded by R. Margaret Kennedy, with all in agreement to deny the extension of a retaining wall as requested by the applicant.


06-20     8:00 p.m.  Jan Dutt, 2135 Morgan Hill Road, Easton, representing Harold and Elizabeth Locke, owners of 816 Prince Street, is seeking relief from front yard setback requirements to construct a covered porch on the front of the residence which is located in an MDR district.

WITNESSES:  JAN DUTT AND HAROLD LOCKE.

A motion was made by R. Margaret Kennedy to approve the relief from front yard setback requirements for this proposed porch.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

06-21     8:10 p.m.  Jason Kocsis of Ruby Corporation, LLC, 3309 Bridlepath Road, Palmer, is seeking relief from section 190-53 A and B, regulating lot area, depth and front yard setbacks in order to build a single family semidetached home on a lot located at 58 Craigie Street and owned by Global Performance, Inc. 2700 William Penn Highway. This permitted by right use located in an HDR district, is also subject to the requirements of special exceptions in Article XX.

WITNESSES: JASON KOSCIS, ROBERT PRETOPAPA, AND THOMAS STITT, ESQ. FOR APPLICANT, AND ELIZABETH MILLER, 60 CRAIGIE STREET.

A motion was made by Cherie Kavanaugh to grant the relief of lot depth and area requirements, but to move the proposed structure back five feet creating a front yard of twenty-two feet and to utilize one-half of a ten-foot wide unopened alley to the rear of the premises to create a thirty-foot buffer when combined with a twenty-five foot rear yard.  This motion was seconded by R. Margaret Kennedy, with all in agreement.
