MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, June 6, 2006 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel, Esq., zoning board solicitor, Charles Roseberry, board chairperson, Robert Gibbons, alternate filling in for Daniel Caravetta, Cherie Kavanaugh, board member, John Embardino, zoning officer, and court reporter Ted Rewak.

 

A motion to accept the minutes of the May 2, 2006, hearings was made by Cherie Kavanaugh, seconded by Charles Roseberry, with two in favor.  Mr. Gibbons was not in attendance at the May 2 hearing.

 

06-22     7:30 p.m.  Shannon Dech, 3015 Freemansburg Avenue, residing in a Medium Density Residential zone, is seeking a special exception per section 190-38 B to operate a lawn care business as a home occupation.

WITNESS:  Shannon Dech

A motion was made by Robert Gibbons to approve this special exception with conditions that the only equipment to be stored on premise is the same equipment used for the applicant’s home lawn care and one open utility trailer as testified.  There is to be no outdoor equipment or material storage except for the utility trailer.  No signage was requested and no signage is approved.  The motion was seconded by Cherie Kavanaugh with all in agreement.

06-23     7:40 p.m.  John Michael Price Sr., residing at 41 Wilden Drive, located in a Medium Density Residential zone, is seeking a variance pursuant to section 190-42 F (1), setting side yard setback requirements, to construct an addition to the left rear of the home which is a pre-existing nonconforming structure.

Witness:  John Price

Cherie Kavanaugh made a motion to grant the variance as requested pursuant to exhibit A-2, with no further side yard encroachment.  The motion was seconded by Robert Gibbons with all in agreement.

06-24     7:50 p.m.  Ken Chiu, 4405 Crosswinds Drive, Easton, PA, is seeking variances for a proposed nail salon at 761 S 25th Street, in the Palmer Town Center, pursuant to section 190-184 A (4) (a), for wall signs exceeding allowable limits on a lot with multiple commercial establishments, and section 190-174 B, limiting signs to three colors.  This proposed use is in a General Commercial zone.

WITNESS:  Ken Chiu

Robert Gibbons made a motion to approve this variance request with the conditions that the outline of the sign to be placed over the entrance door be outlined with either a black or blue color, limiting the maximum colors of all signage to four colors and to accept the size of the signs as presented on exhibits A-2 and A-2 and a requirement that signs are to be turned off at the close of business.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

06-25     8:00 p.m.  Brett and Kelly Kleppinger, 13 Grist Mill Lane, are seeking a special exception per section 190-38 B, to operate a 1 chair hair salon in a proposed addition, as a home occupation.  These premises are located in a Planned Residential Development in a Medium Density Residential zone.

WITNESSES:  Brett and Kelly Kleppinger.

Cherie Kavanaugh made a motion to approve this one chair salon home occupation special exception with conditions that clients are by appointment only with no overlapping appointments and all customer parking be in the driveway of the home and that there be no other employees other than Mrs. Kleppinger.  No sign was requested and none is approved.  The motion was seconded by Robert Gibbons, with all in agreement.
