MINUTES
OF ZONING HEARING BOARD MEETING
The zoning
hearing board of Palmer
Township met on Wednesday September 6, 2006,
at 7:30 P.M. in the
Palmer Memorial Library, One Weller Place,
to hear the following appeals. In
attendance were Nicholas Noel III, zoning board solicitor, Charles Roseberry,
board chairman, Cherie Kavanaugh and Daniel Caravetta, board members, and Robert
Gibbons and R. Margaret Kennedy, alternates, John A. Embardino, zoning officer,
and court reporter Ted Rewak.
A motion was made by Cherie Kavanaugh to
approve the amended minutes of the August 1, 2006 meeting.
The motion was seconded by Daniel Caravetta, with all in agreement.

7:30 p.m.
Crossroads of Nazareth, LLC, is seeking relief from sections, 190-74 G,
requiring minimum setback distances from other access points on a minor
arterial road, 190-254, requiring sidewalks for new land development in the
Route 248 overlay district, and 190-170, requiring off-street loading
facilities for a proposed medical office building at 3465 Nazareth Road,
located in a PO/B zone in the Route 248 overlay district.
WITNESSES:
Joseph Firetto, and Clyde Odom of Buckl Architects, Jeffrey Ott and Michael Waldron of Ott Consulting, Inc., and Dr. Hayman
Salib.
ACTION:
Daniel Caravetta made a motion to grant relief from sections 190-74 G,
requiring minimum setback distances from other access points along a minor
arterial road, and 190-170, requiring off-street loading facilities, but to
deny relief from 190-254, requiring sidewalks within the Route 248 overlay
district. This motion was seconded by Cherie
Kavanaugh, with all in agreement.

7:40 p.m.
Kenneth Deemer, residing at 3124 Jones
Boulevard, is seeking a special exception pursuant to section 190-38 B, to
operate a deck care business as a home occupation in a MDR zoning district.
WITNESSES:
Kenneth Deemer, Geoff Deemer,
Mrs. Bernice Moll, owner of 3124 Jones Boulevard, Frank Pensyl, 3112 Jones Boulevard.
ACTION:
Cherie Kavanaugh made a motion to grant this special exception with the
condition that all signage be removed from the applicants business vehicles, or
in lieu of that, the vehicles to be stored inside a garage or removed from the
premises and since no sign was requested for the premises, none to be
granted. The motion was seconded by Daniel
Caravetta, with all in agreement.

7:50 p.m.
Barry Fehnel, of Trademark Builders,
Bethlehem, PA is seeking relief from sections 190-42 A (1) and 190-42 C, to
build a single family detached home at 600 Berks Street, a corner lot lacking
sufficient area and lot depth. This
vacant lot, owned by Anthony Malinowski, Somerville, NJ,
is located in an MDR zoning district.
Daniel Caravetta recused himself from this
hearing and was replaced by alternate Robert Gibbons.
WITNESSES:
Barry Fehnel, Margaret Taylor, 604 Berks Street, Rosario Sottosanti, 1600 Blair Street.
ACTION:
Robert Gibbons made a motion to grant relief lot area and depth
requirements. The motion was seconded by
Cherie Kavanaugh, with all in agreement.

8:00 p.m. Carl and Barbara Miller, 109 Oxford Drive,
are seeking a special exception pursuant to section 190-29 B, for a conversion
of an existing single family detached dwelling into a dwelling with an
accessory apartment located in an LDR zoning district.
WITNESSES:
Carl and Barbara Miller.
ACTION:
Daniel Caravetta made a motion to grant this special exception as
requested with the condition that upon no further need for this accessory
apartment for the use of a relative, the home be reverted to a single family
dwelling. The motion was seconded by Cherie
Kavanaugh, with all in agreement.

8:10 p.m. Fay
Pacchioli, trading as Sandy Kings Pets and Supplies,
located at 1059 S. 25th Street located in a GC zoning district, is
seeking relief from section 190-184 A (3) (b) [1], [2] and [3], to erect a second
freestanding sign in excess of the number and size allowed on a lot with
deficient street frontage required for a second sign.
WITNESSES:
Fay Pacchioli, Rhonda Pacchioli.
ACTION:
Cherie Kavanaugh moved to deny this request for a second freestanding
sign. The motion was seconded by Daniel
Caravetta, with all in agreement.
Having no further business to discuss, the hearing was adjourned.
