MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, December 5, 2006, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, zoning board solicitor, Charles Roseberry, board chairman, board members Cherie Kavanaugh and Robert Gibbons alternate, filling in for Daniel Caravetta, and R. Margaret Kennedy, alternate, John A. Embardino, zoning officer, and court reporter Ted Rewak

 

A motion was made by Cherie Kavanaugh to approve the minutes of the November 7 zoning hearings.  This motion was seconded by Charles Roseberry, with all in favor

 

06-43      7:30 p.m.  Linda M. Janson, 2652 Northview Avenue is seeking a special exception pursuant to section 190-38 B, to operate a gift basket business as a home occupation in an MDR district.

WITNESSES: LINDA AND JOHN JANSON, RICHARD ALDINGER, EVELYN PASCAL, 3500 Rocky Lane, CHARLES SEIBOLD, 3510 Rocky Lane.

ACTION: Cherie Kavanaugh made a motion to grant this special exception as requested, with a one square foot sign in compliance with zoning regulations to be allowed, and with no retail sales at the residence and to follow zoning guidelines for a home occupation.  This motion was seconded by Robert Gibbons, with all in agreement.

 

06-44  7:40 p.m.  Strausser Enterprises, Inc., 1108 Van Buren Road is seeking relief from sections 190-54 AA (1), 190-154 I (2), X, and Y; 190-58.8 W, X and Z to provide individual mailboxes, individual trash collection, to allow up to 420 feet maximum distance to guest parking, and to allow a cul-de-sac to be constructed in a 100 year flood plain, relating to townhouses to be constructed in HDR and HDR-2 zoning districts at the proposed Wolf Run IX development on Van Buren Road.

WITNESSES:  SAL PANTO,(STRAUSSER ENTERPRISES), PHILLIP; SEIBERT,(OTT CONSULTING), THOMAS NOLAN, 116 Glenmoor Circle, MICHAEL SARTINI, 135 Clover Hollow Road, JOHN HALLIGAN, 12 Canterbury Lane.

ACTION: Robert Gibbons made two motions, one to grant relief for individual mailboxes, and a second motion to grant relief for individual trash collection.  Both motions were seconded by Cherie Kavanaugh, with all in favor in both motions.  Cherie Kavanaugh made a motion to grant relief from distances for guest parking and Robert Gibbons seconded the motion.  All were in favor.  Charles Roseberry made a motion to grand the construction of a cul-de-sac in a 100 year flood plain for road “Y” as depicted in exhibit A-2, but to deny the construction of a cul-de-sac in a 100 year flood plain for road “Z” as depicted in exhibit A-2.  This motion was seconded by Robert Gibbons, and the motion passed with a 2 yes and 1 no vote.

 

06-45  7:50 p.m.  Paul Q. McLaine, trading as PQ and Associates LLC, 3320 Nazareth Road, is seeking special exceptions pursuant to sections 190-199 C (3) and F (2) to expand and change a nonconforming nonresidential use to add a flooring showroom to an existing business at this location situated in an LDR zoning district.

WITNESSES: PAUL McLAINE, DREW SIGAFOSS AND JULIE SCOTT (HAMPTON FLOORING)

ACTION:  Cherie Kavanaugh made a motion to grant this special exception for a flooring showroom only, with no warehousing and no change in size of the freestanding sign in front of the business.  The motion was seconded by Robert Gibbons, with all in agreement.

 

06-46            8:00 p.m.  John W. Lister, architect, West Chester, PA, representing Starbucks Coffee Company, is seeking a variance from section 190-184 A (4) (a) to install permanent signs exceeding the maximum area allowed on a lot with more than one commercial establishment, and to place them on the front wall and windows of a proposed business to be located at 677 25th Street in the Palmer Towne Center, situated in a general commercial zoning district.

WITNESS:  JOHN W. LISTER, ARCHITECT FOR STARBUCKS.

ACTION:  Charles Roseberry made a motion to grant this request for signage as presented.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

06-47  8:10 p.m.  James W. Brown III and Kellie Provost-Brown, 105 Forest Line Road, are seeking setback relief from section 190-53, to enclose an existing deck to the rear of their home which is located in a high density zoning district.

WITNESSES:  KELLIE PROVOST BROWN, JOHN REICHENBACH, CONTRACTOR.

ACTION:  A motion was made by Cherie Kavanaugh to grant the setback relief as requested, with Robert Gibbons as a second to the motion and all were in agreement.

 

Having no further business to discuss, the hearing was adjourned.
