MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Wednesday, January 3, 2007, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, zoning board solicitor, Charles Roseberry, board chairman, board members Cherie Kavanaugh and Daniel Caravetta, and Robert Gibbons alternate, John A. Embardino, zoning officer, and court reporter Ted Rewak

 

A motion was made by Cherie Kavanaugh to approve the minutes of the December 5, 2006 zoning hearings.  This motion was seconded by Charles Roseberry, with all in favor.

 

A motion was made by Cherie Kavanaugh, seconded by Daniel Caravetta, with all in favor, to reappoint Charles Roseberry as chairman of the zoning hearing board for year 2007. 

 

A motion was made by Charles Roseberry, seconded by Daniel Caravetta, with all in favor, to approve a resolution to appoint Attorney Nicholas Noel, III, of the Law Firm of Noel, Kovacs & McGuire as solicitor for the zoning hearing board at an hourly rate of $115.00 for partners and $80.00 per hour for paralegal. 

 

07-01                  7:30 p.m.  Arthur Jones, 39 Country Side Court, is seeking relief from required rear yard setbacks for a covered patio pursuant to section 190-194 B (4) (b).  These premises are located in a Planned Residential Development (PRD) in an (MDR) Medium Density zoning district.

WITNESSES.  ARTHUR AND LOLITA JONES.

ACTION:  A MOTION WAS MADE BY DANIEL CARAVETTA TO GRANT PARTIAL RELIEF OF A ROOF INTO THE REAR YARD SETBACK REQUIREMENT.  THE ROOF IS TO EXTEND NO FURTHER THAN 12 FEET FROM THE REAR OF THE HOME WITH A MAXIMUM SIZE BEING 12 FEET DEEP BY 16 FEET WIDE, AND TO ALLOW THE PATIO THAT IT COVERS TO BE OPENED SIDED OR SCREEN ENCLOSED.  THE MOTION WAS SECONDED BY CHERIE KAVANAUGH, WITH ALL IN AGREEMENT.

 

07-02                  7:40 p.m.  Jeffrey Coleman and Helena Coleman, owner of 3601 Nazareth Road, represented by Gary Neil Asteak, Esquire, is presenting a challenge to the zoning officer’s interpretation of sections 190-122, and specifically 190-122 O and 190-122 R to seek relief to lease a portion of Northwood Corner as a Hertz Rent-a-Car business.  These premises are located in a Planned Industrial Commercial (PIC) zoning district.

THIS HEARING WAS CANCELLED AT THE REQUEST OF THE APPLICANTS THEREFOR; NO ACTION WAS TAKEN ON THIS REQUEST.

 

Having no further business to discuss, the hearing was adjourned.
