MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, February 6, 2007, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, zoning board solicitor, Charles Roseberry, board chairman, board members Cherie Kavanaugh and Daniel Caravetta, and Robert Gibbons alternate, John A. Embardino, zoning officer, and court reporter Ted Rewak

 

A motion to approve the minutes of January 3, 2007 was made by Cherie Kavanaugh, seconded by Daniel Caravetta, with all in agreement.

 

07-03                 7:30 p.m.  Stephen and Paula Lombardo, 3323 Kaywood Drive are seeking   relief from required rear yard setbacks per section 190-42 G (1), for a proposed addition to be built to the rear of their home.  These premises are located in an (MDR) Medium Density Residential zoning district.

WITNESSES:  Sandra Lombardo, Stephen Lombardo, John Reichenbach, contractor.

ACTION:  A motion was made by Daniel Caravetta to deny this request for rear yard setback for an addition for a living area.  The motion was seconded by Cherie Kavanaugh, and all were in agreement.

 

07-04                  7:40 p.m.  Douglas Stem, owner of 1818 Tavern, 2501 Seip Avenue, is requesting a special exception to expand a nonconforming use pursuant to section 190-199 C (3), by increasing the size of a parking lot, and is also seeking relief from maximum impervious coverage requirements pursuant to section 190-42 D.  These premises are located in an MDR, (medium density residential) district.

WITNESSES:  Doug and Tammy Stem

ACTION:  A motion was made by Cherie Kavanaugh, and seconded by Daniel Caravetta to approve this special exception expansion of a nonconforming use and to allow relief from the impervious coverage requirements to add more parking as depicted in exhibit A-2, with the conditions that the area be paved, and striped as angle parking, and the west driveway to be used for one way traffic exiting the premises onto Seip Avenue.  This motion was passed with all in agreement.

 

07-05                  7:50 p.m.  Samuel Burgio, of S.B. and Son Real Estate, is seeking a special exception pursuant to section 190-199 F, to change from one nonconforming use to another in a portion of a multi-use commercial building located at 190 S. Greenwood Avenue.  In addition he is seeking to add an additional use for a future business.  These premises are located in a medium density (MDR) zoning district.


WITNESSES:  Samuel Burgio, owner, Amit Nar and Terry Cox, representing “A Better Night’s Sleep”.

ACTION:  Daniel Caravetta made a motion to approve this special exception for a change from one nonconforming use to another in a proposed approximately 2000 square foot area of the first floor.  The request for a future unspecified use for the remainder of the first floor area was denied due to lack of sufficient information.  This motion was seconded by Cherie Kavanaugh, with all in agreement.

 

07-06                  8:00 p.m.  Jennie Melhem, 3424 Oregon Street, is seeking relief from sections 190-54 E; 54 C; 54 M; 54 AA(1); and 190-150 A (1), pertaining to density of structures, parking setbacks, external lot line setbacks and visitor overflow parking for a proposed 2 building, 8 unit townhouse development on Williamson Street.  The proposed project is located in a medium density residential district, but the applicant is seeking relief from high density residential requirements for a potential zoning district change.

WITNESSES:  Don Fredrickson of Environmental Engineering, West Easton, Philip Hof, Esq., Ed Melhem, David Grucela, 1247 Anna Marie Street, Richard Head, 4 Lieberman Terrace, Mitchell and Katherine Ricker, 1222 Williamson Street, Dave Sullivan, 1205 Williamson Street, John Rizzolo 1209 Williamson Street, Warren Butler, 117 S. 5th Street, Easton, owner of premises at 1210 Williamson Street.

ACTION:  The following motions, contingent on approval by the Board of Supervisors approving a zoning change of the premises to High Density Residential, were made by Cherie Kavanaugh:

1)      To grant relief from density calculations of section 190-54 E to allow the proposed two (2) buildings totaling eight (8) living units;

2)      To grant relief from section 190-54 C, to allow front entrance garages and front yard off street parking;

3)      To grant relief from the eighty (80) foot setback requirements from a single family detached residential lot line pursuant to section 190-54 M;

4)      To grant relief from overflow parking regulations of section 190-54 AA (1), which would require two (2) parking spaces;

5)      To grant requested relief from steep slope requirements of section 190-150 A. 

All of these motions were seconded by Daniel Caravetta, and all were passed with unanimous agreement.

 

Having no further business to discuss, the hearing was adjourned.
