MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, March 6, 2007, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, zoning board solicitor, Charles Roseberry, board chairman, board members Cherie Kavanaugh and Daniel Caravetta, with Robert Gibbons and R. Margaret Kennedy, alternates, John A. Embardino, zoning officer, and court reporter Ted Rewak

 

A motion to approve the minutes of February 6, 2007 was made by Cherie Kavanaugh, seconded by Daniel Caravetta, with all in agreement.

 

07-07             7:30 p.m.  The Norwood Company, 974 Marcon Boulevard, Allentown, PA, is seeking relief from section 190-210 B (33) (e) requiring a trucking terminal to be located within a one-mile radius of an interchange of Route 33, and is also seeking interpretation of this same section relative to the application of trucking terminal standards to a proposed distribution center to be located at 2251 Newlins Mill Road, situated in a PO/IP zoning district.

WITNESSES:  LEO DeVITO, ESQ., THOMAS MEAGHER, REPRESENTING NORWOOD COMPANY, PAUL SZEWCZAK, OF LIBERTY ENGINEERING, ROBERT HOFFMAN, OF TRAFFIC PLANNING AND DESIGN, ANDERSON RAUB, 1470 TATAMY ROAD, JEFFREY RAUB, 1459 TATAMY ROAD, AND CLARENCE FEHNEL, 2120 NEWLINS MILL ROAD.

ACTION:  A motion was made by Daniel Caravetta affirming that an interpretation that trucking terminal requirements pertain to a distribution center apply, but to grant relief from the 1 mile radius to a route 33 interchange requirement due to the proposed improvements being made to Newlins Mill Road.  This motion was seconded by Cherie Kavanaugh, will all in agreement.

 

07-08             7:40 p.m.  Cathy and Dave Staples, 53 Stonecroft Drive, located in an MDR zoning district, are seeking a special exception pursuant to section 190-38 B, to operate a public relations consulting business as a home occupation.

WITNESSES:  DAVE STAPLES.

ACTION:  A motion to grant this special exception was made by Cherie Kavanaugh, allowing one part time employee on condition that all parking to be off-street, and since no sign was requested, none was approved.  The motion was seconded by Daniel Caravetta, with all in agreement.


 

07-09             7:50 p.m.  Salvatore and Mario Famularo, 3905 Freemansburg Avenue, located in an MDR zoning district, are seeking relief from section 190-42 B (1), to create a flag lot having less than a 200-foot width required for a lot with direct vehicular or pedestrian access to a minor arterial road.

WITNESSES:  STANLEY MARGLE, ESQ., DON FREDERICKSON, ENVIRONMENTAL ENGINEERING, MARIO FAMULARO, 770 BUTTERNUT LANE.

ACTION:  A motion to grant the frontage relief was made by Daniel Caravetta.  This motion was conditioned that the two proposed lots have separate means of ingress and egress, and that the western portion of an existing “horseshoe” shaped driveway be removed from the road frontage back to the building restriction line of lot 1, and that clear sight triangles at the driveway exits for both lots be provided.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

07-10             8:00 p.m.  Nicholas Pugliese, 1072 Grand Street, Phillipsburg, NJ, is seeking from section 190-211 E (7) (d) [4], to construct a retaining wall on a lot for a proposed office building on Community Drive, located in PO/B zoning district.

WITNESSES:  NICHOLAS PUGLIESE, DON FREDERICKSON, ENVIRONMENTAL ENGINEERING.

ACTION:  A motion to grant relief from setback requirements and to allow no encroachment closer than 3 feet to the property line for retaining wall “A” on exhibit A-3 was made by Cherie Kavanaugh, and seconded by Daniel Caravetta, with all in agreement.

 

Having no further business to discuss, the hearing was adjourned.
