MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, June 5, 2007, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, zoning board solicitor, Charles Roseberry, board chairman, board members Cherie Kavanaugh and Daniel Caravetta, and Robert Gibbons and R. Margaret Kennedy, alternates, John A. Embardino, zoning officer, and court reporter Ted Rewak

 

A motion to approve the minutes of May 1, 2007 was made by Cherie Kavanaugh, seconded by Daniel Caravetta, with all in agreement.

07-16      7:30 p.m.  George Short, 717 Hickory Lane is seeking a variance for relief from section 190-169 to park a commercial vehicle on his premises located in a Medium Density Residential zoning district.

WITNESSES: George Short; Gene Rooney and Marian Amorose, 805 Hickory Lane; Michelle Knight, 3716 Haupt Street; Alexander Lasorsa, 716 Chestnut Lane; Douglas Leisy, 722 Hickory Lane.

ACTION:  A motion was made by Daniel Caravetta to deny this request for a variance to park a commercial vehicle in a residential district.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

07-17   7:40 p.m.  Marie A. Peluso, 62 Jonathon Drive, is seeking relief from sections 190-42 E (4) and F (1), front and side yard setback requirements, and section 190-194 B (4) (b), front yard encroachment regulations, to build an addition to the side and rear and a porch on the front of her existing home which is located in a Medium Density Residential zoning district.

WITNESSES:  Marie Peluso; Joseph Finocchio, 4970 Harvey Road, Bethlehem, PA 18020 (owner 72 and 74 Jonathon Drive.

ACTION:  A motion was made by Cherie Kavanaugh to grant and side yard variance of a two-foot encroachment to a allow a side yard setback of eight (8) feet for a proposed addition to the home, and to allow a covered front porch with a dimension of 7 feet deep by 12 feet wide or to meet the front door side edge of existing front windows, whichever is the least restrictive.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

07-18   7:50 p.m.  Philip M. Finelli, 12 Olde Penn Drive, is seeking relief from section 190-211 E (19) (d) to place an above ground pool in a front yard of the premises located in a Planned Residential Development in a Medium Density Residential zoning district.

WITNESSES:  Philip Finelli.

ACTION:  A motion was made by Daniel Caravetta to grant this request for a temporary pool in a front yard conditioned on the pool size not exceeding 16 feet in diameter and that if can be erected for a period of 4 months in any calendar year.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

07-19   8:00 p.m.  Laura Deemer, 3414 Greenway Street, is seeking relief from section 190-42 F (1), side yard requirements, and 190- 199 C, expansion of nonconforming uses regulations, in order to build an addition to the rear of the home that is located in a Medium Density Residential zoning district.

WITNESSES:  Laura Deemer and Nancy Jewett, 3414 Greenway Street; Jay Miller and Harold Scott, contractors.

ACTION:  Cherie Kavanaugh made a motion to grant side yard relief for a proposed 15-foot by 28-foot addition to the rear of the premises, maintaining a 6’6” side yard setback consistent with the main structuren.  Daniel Caravetta seconded the motion and all were is agreement.

 

07-20    8:10 p.m.  Michael Curcio, 1 Maplecroft Avenue, is seeking relief from section 190-82-D (3) (4), front yard setback requirements and section 190-199 C (2) (a) [5], to construct an addition to his home, a non-conforming use located in a General Commercial zoning district.

WITNESSES:  Michael Curcio, 1 Maplecroft Avenue; Frank Curcio, 2043 Arnt Road, Easton, PA 18040.

ACTION:  Daniel Caravetta mad a motion to grant front yard relief for a proposed addition to the rear of the premises, and to grant a maximum of two (2) feet encroachment into the front yard along Maplecroft Avenue for the construction of a porch with a maximum size of 8 feet deep by 20 feet wide.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

07-21   8:20 p.m.  Tim and Amanda Shepherd, 2707 Spring Garden Street, are seeking relief from section190-42 E (4) and F (1), requiring front and side yard setback distances, in order to construct a carport to the front of their home which is located in a Medium Density Residential zoning district.

WITNESSES:  Tim and Amanda Shepherd 2707 Spring Garden Street.

ACTION:  Daniel Caravetta made a motion to grant the construction of a carport to the front of the premises on the conditions that the carport be no larger than 20 feet deep, leaving a 21-foot front yard, and that the side yard setback remain at 8 feet, consistent with the setback of the existing garage.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

07-22   8:30 p.m.  Geoffrey and Thurza Bruen, 120 Carbon Street, are seeking relief from section190-194 B (4) (b), to construct a covered front porch exceeding the size allowed to encroach into a front yard of a lot located in a Medium Density Residential zoning district.

WITNESSES:  Geoffrey and Thurza Bruen, 120 Carbon Street.

ACTION:  Cherie Kavanaugh made a motion to grant request for a 7-foot deep by 14-foot wide, open sided front porch.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

Having no further business to discuss, the hearing was adjourned.
