MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Wednesday, September 5, 2007, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Maura McGuire, alternate zoning board solicitor, Charles Roseberry, board chairman, board members Cherie Kavanaugh and Daniel Caravetta, and Robert Gibbons and R. Margaret Kennedy, alternates, John A. Embardino, zoning officer, and court reporter Ted Rewak

 

A motion to approve the amended minutes of August 7, 2007 was made by Cherie Kavanaugh, seconded by Daniel Caravetta, with all in agreement.

 

07-37            7:30 p.m.  Easton Area High School, Class of 2004, is seeking a variance from section  190-180 A and B, prohibiting moving or animated signs, to erect an electronic LED message board type sign at the 25th Street entrance to the high school.  The school is located in a conservation recreation zoning district.

WITNESSES:  William Rider, Principal, EAHS

ACTION:  ACTION TAKEN IN THIS MATTER IS PENDING PRESENTATION OF PROOF OF STANDING TO SOLICITOR’S OFFICE.  IN ADDITION, THE APPLICATION WAS ORALLY AMENDED BY THE APPLICANT TO INCLUDE A REQUEST FOR A VARIANCE FROM AREA OF SIGN REGULATIONS PURSUANT TO SECTION 190-183.1 B (2).  Cherie Kavanaugh made a motion to deny this request for this specifically prohibited type of sign in that applicant did not prove a hardship for the placement of this sign.  The motion was seconded by Daniel Caravetta, with all in agreement.

07-38            7:40 p.m.  John Strom, 56 Corriere Road, located in a PRD in a Medium Density Residential zoning district, is seeking a special exception pursuant to section 190-38 B, to operate bicycle fitting business as a home occupation, and in addition, a variance from section 190-166 A (1) and Table 17.1, waiving the required number of parking spaces required.

WITNESSES:  John Strom.

ACTION:  Daniel Caravetta made a motion to grant this special exception with the stipulation that there be no exterior modification to the garage doors, and that the owner be the only employee working on an appointment basis and only one client at a time at the premises, and to grant a 1 square foot sign on premise.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

07-39             7:50 p.m.  Joseph R. Burgey and Gail E. Burgey, M.D., 312 Wedgewood Drive, located in a Low Density Residential district, are seeking a special exception pursuant to section 190-29 C, to operate a landscaping/lawn care business as a home occupation.

WITNESSES:  Brian Monahan, Esq., Joseph Burgey, Mark Convy, Esq., 5 Courtney Court, Lucille McNellis, 318 Wedgewood Drive, Linda Lewis, 325 Wedgewood Drive.

ACTION:  Daniel Caravetta made a motion to approve this special exception with stipulations that no on premise parking or storage of equipment or vehicles except for a one ton dump truck as noted pursuant to applicant’s testimony, with said truck to be parked or stored on premises and not in the required front yard.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

07-40             8:00 p.m.  TCAAB Associates LLC, 3357 William Penn Highway, are seeking a variance from Article XVII, section 190-168 D (1) (c) regulating setbacks from a property line for driveways in conjunction with site development at 3353 William Penn Highway, located in a base General Commercial zoning district in the William Penn Highway overlay district.

WITNESSES:  JEFFREY YOUNG, JULES MIKNYOCZKI, OWNERS, Steve Molder, Esq.

ACTION:  Cherie Kavanaugh made a motion to approve this relief of Article XVII for driveway setback, with Daniel Caravetta as second to the motion and all were in agreement.

 

Having no further business to discuss, the hearing was adjourned.
