MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, December 4, 2007, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, Esq. zoning board solicitor, Charles Roseberry, board chairman, board members Cherie Kavanaugh, alternate Robert Gibbons, alternate, filling in for Daniel Caravetta, and R. Margaret Kennedy, alternate, John A. Embardino, zoning officer, and court reporter Ted Rewak

 

A motion to approve the amended minutes of November 6, 2007 was made by Cherie Kavanaugh, seconded by Charles Roseberry, with all in agreement.

 

07-43            7:30 p.m.  Michael and Debra Oren, 301 Watson Street, are seeking relief from front yard setback requirements of section 190-42 E (4), to build an addition and an accessible ramp that would encroach upon two of three street frontages of this corner property located in an MDR zoning district.

WITNESSES:  Michael and Debra Oren

ACTION:  Cherie Kavanaugh made a motion to grant relief of front yard setback requirements as requested by the applicants, for the proposed addition and access ramp, with the stipulation that the ramp be removed when no longer necessary for use by the owners.  The motion was seconded by Robert Gibbons, with all in agreement.  This relief is stipulated on verification to the zoning board solicitor, a document of agreement of the co-owner of the premises.

 

07-44            7:40 p.m.   William Koch and Donna DeBenedetto, representing Spectrum of Floors, LLC, 3700 William Penn Highway, are seeking relief from section 190-191 A, allowing only one principal use per lot, to place a second use in their place of business for the purpose of retail, professional or service oriented businesses.  The premises are located in a General Commercial zone of the William Penn Overlay District.

WITNESSES:  William Koch

ACTION:  This hearing was continued at the request of the applicant in order to present to the board a specific second tenant for the premises and to have the co-owner of the premises testimony of agreement to the hearing proceedings.  The applicant waived the 60 day requirement for a zoning hearing to take place.  The board was in agreement to this request for a continuance.

07-45            7:50 p.m.  Strausser Enterprises, 1108 Van Buren Road, Palmer, PA, is seeking relief of sections 190-42 B and 190-54 M, in order to construct two single family homes on a proposed subdivision on the southeast quadrant of Kathryn Street and Hay Terrace.  The proposed subdivision will need variances for lot width along a street frontage and external setback requirements from existing townhouses to the south.  The premises are located in a medium density zoning district.

WITNESSES:  None

ACTION:  Exhibits T-17 and T-18, emails from Sal Panto, Jr., Chief Executive Officer of Strausser Enterprises, Inc., and Leonard Mellon, Esq., attorney for the applicant respectively, were presented to the board asking for a continuance of this hearing and waiving the 60 day requirement for a zoning hearing to take place.  The board was in agreement to this request for a continuance.

 

Having no further business to discuss, the hearing was adjourned.
