MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, October 7, 2008, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, Esq., zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh, and Daniel Caravetta, board members, John A. Embardino, zoning officer, and court reporter Ted Rewak.

 

Cherie Kavanaugh made a motion to approve the minutes of September 3, 2008, with Charles Roseberry as second and two in agreement.  Daniel Caravetta was not in attendance on September 3.

 

08-36 7:30 p.m.  Dawn DeVries, 200 Brendan Road, located in a Medium Density Residential district, is seeking a special exception pursuant to section 190-38 B, to operate a property maintenance and home repair business as a home occupation.

WITNESSES:  Dawn DeVries

ACTION:  Upon swearing under oath that Helen Krum, co-owner of the premises, had no objections to this proposed home occupation, Ms. DeVries was found to have standing for the hearing.  Daniel Caravetta made a motion to approve this special exception with the condition that there be no on-site storage of construction materials and that since no sign was requested, none was granted at this time.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

08-37 7:40 p.m.  Juan Irizarry, 2864 Washington Street, located in a Medium Density Residential district, is seeking a special exception pursuant to section 190-38 B, to operate a home improvement business as a home occupation.

WITNESSES:  Juan Irizarry

ACTION:  Cherie Kavanaugh made a motion to approve this special exception with the conditions that no on-site storage of materials or heavy equipment be allowed and since no sign was requested, none was granted at this time.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

08-38  7:50 p.m.  Rodney and Lori Gischel, 2720 Northwood Avenue, located in a Medium Density Residential zoning district, are seeking variances pursuant to sections 190-211 E (15) [a] [i] and [ii], in order to construct a detached garage in excess of allowable height and area limits.

WITNESSES:  Rodney Gischel;  William Gischel, 2925 Hartley Avenue.

ACTION:  Daniel Caravetta made a motion to approve the relief of height and area restrictions as requested and presented with the conditions that at no time shall this garage be used for residential occupancy and that it be used for personal storage only with no commercial use or storage allowed.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

08-39  8:00  p.m.  Michael Schroer, 3201 Jones Boulevard, located in a Medium Density Residential district, is seeking a special exception pursuant to section 190-38 B, to operate an internet sales business with one other employee, as a home occupation.

WITNESSES:  Michael Schroer, Bob Corona, 3202 Vermont Street, Mildred Van Billiard, 3208 Jones Boulevard.  Mr. Corona read a notorized letter from Mario Alercia, 801 Greenwood Avenue, and introduced it as objector’s exhibit O-1.

ACTION:  Daniel Caravetta made a motion to grant the home occupation as an internet sales business with one employee with the conditions that all vehicles and materials pertaining to a concrete cutting business be removed from the premises immediately and that all activity related to the concrete cutting business cease.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

08-40  8:10 p.m.  Virginia Melin, 3210 Highland Drive, located in a Light Density Residential zoning district, is seeking a special exception pursuant to section 190-29 C, to operate a music instruction business as a home occupation.

WITNESSES:  Virginia and William Melin.

ACTION:  Cherie Kavanaugh made a motion to approve this special exception as a musical teaching studio by appointment only, with no sign requested and none granted at this time.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

08-41  8:20 p.m.  Industrial Developments International, Inc. (IDI), Radnor, PA, is seeking relief from sections 190-168 D (1) (a) [1] and  190-170 B (4), restricting maximum driveway widths allowed, and section 190-170 B (1) requirements for loading space size, in order to accommodate trucks for a proposed development on proposed Commerce Lane in the proposed Chrin Commerce Center north of the Palmer Industrial Park, located in a Planned Office/Industrial Park district.

WITNESSES:  Blake Marles, Esq., Gregory Elko of Langen Engineering, Charles Stehlik.

ACTION:  Daniel Caravetta made a motion to grant relief from sections 190-168 D (1) (a) [1] and 190-170 B (4), pertaining to driveway and access width for trucks, and section 190-170 B (1) pertaining to loading dock area and allowing a 12.5 foot width amending the original request of and 11-foot loading dock width.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

08-42  8:30 p.m.  Strausser Enterprises, 1108 Van Buren Road, is seeking special exceptions pursuant to sections 190-154 I (2) and (4), to construct portions of a parking area, driveway and grading in a flood zone for a proposed life care center in the proposed Village at Wolf’s Run development on Van Buren Road located in a High Density Residential district.

ACTION:  This hearing was postponed until the applicant receives conditional use approval and therefore had no standing to appear in front of the zoning board.
