MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, March 4, 2008, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, zoning board solicitor, Charles Roseberry, board chairman, board members Cherie Kavanaugh and Robert Gibbons, alternate, sitting in place of Daniel Caravetta, R. Margaret Kennedy, alternate, John Embardino, zoning officer, and court reporter Ted Rewak

 

A motion by Cherie Kavanaugh and seconded by Charles Roseberry to approve the minutes of February 5, 2008 was passed with all in agreement.

 

08-02     7:30 p.m.  Robert Minotti, 2612 Swanson Street, is seeking a special exception pursuant to section 190-38 B, in order to operate a home occupation as a mobile auto tech touch-up detailing business, and is also seeking relief from section 190-211 E 10 (a) [4], in order to keep signage on a vehicle in lieu of a permitted on-premise sign.  The premises are located in a medium density residential zoning district.

WITNESSES:  Robert and Tina Minotti.

ACTION:  A motion was made by Cherie Kavanaugh to grant this special exception to operate a detailing business with work being done at dealerships and a vehicle with advertising on it to be allowed on premises but to be placed inside the garage when at the residence.  In addition, no materials to be stored on premises except for what is stored in the vehicle used for the business, and no on-premise sign granted as none was requested.  The motion was seconded by Robert Gibbons and all were in agreement.

 

08-03     7:40 p.m.  Mandy Partners, c/o Martin D. Cohen, Esq., Bethlehem, PA, is seeking relief from section 190-54 BB that requires a minimum of a one-hundred foot setback for low-rise apartment buildings to any HI, LI, PIC, or PO/IP zoning districts for a proposed apartment development along the west side of Van Buren Road, north of Fox Hill Road.  The proposed development is located in a Planned Industrial/Commercial zoning district and this variance is sought, predicated on a zoning change for the premises from a Planned Industrial/Commercial district to a High Density Residential zoning district.

ACTION:  Solicitor Noel read into the record an email correspondence received from Erich J. Schock of Fitzpatrick, Lentz and Bubba, P.C., Attorneys at Law, requesting a continuance of this hearing to May 6, 2008, and waiving the applicable time period under the Pennsylvania Municipalities Planning Code to have a hearing.  Charles Roseberry motioned to accept the continuance request with Robert Gibbons acting as a second to the motion.  All were in agreement.

 

Having no further business to discuss, the hearing was adjourned.
