MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday August 5, 2008, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nicholas Noel III, Esq., zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh and Daniel Caravetta, board members, R. Margaret Kennedy, alternate, John A. Embardino, zoning officer, and court reporter Ted Rewak.

 

A motion to approve the minutes of the July 1 ,2008 hearings was made by Cherie Kavanaugh and seconded by Daniel Caravetta, with all in agreement.

 

08-23 7:30 p.m.  SCI Palmer Town Center Fund, LLC, c/o FAMECO Management Services, L.P., is seeking relief from section 190-184 A 4 (b) [1] and [2], restricting the size and number of freestanding signs relating to more than one commercial establishment on a lot.  The applicant requests additional sign area to include identification lettering on existing freestanding signs at three locations within the Palmer Town Center, located in a general commercial zoning district on south 25th Street.

WITNESSES:  Vincent Mancino, Esq.; Duane Horne of FAMECO management.

ACTION:  Mr. Mancino requested an amendment to this application to include relief from maximum height of ten feet for freestanding signs, pursuant to section 190-183 A.  This request was accepted by the board.

         A motion was made by Daniel Caravetta to grant relief as requested for the identification signs as presented in exhibits A-4, A-5, and A-6.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

08-24 7:40 p.m.  Robert Sivells, 153 N. Greenwood Avenue, located in a medium density residential district, is seeking relief from sections 190-199c (1) (a) [1] and 190-168 D (1) (c), restricting the expansion of a nonconforming use and setbacks for driveways in order to connect his driveway to an abutting neighboring driveway.

WITNESSES:  Robert Sivells; Richard Bodine, 155 N. Greenwood Avenue

ACTION:  This hearing was held in combination with hearing 08-25 and was continued to September 3, 2008, pending an appearance by the paving contractor, James Piperato of J. Pips Paving.

 

08-25 7:50 p.m.  Richard Bodine, 155 N. Greenwood Avenue, located in a medium density residential district, is seeking relief from sections 190-199c (1) (a) [1] and 190-168 D (1) (c), restricting the expansion of a nonconforming use and setbacks for driveways in order to connect his driveway to an abutting neighboring driveway. 

WITNESSES:  Richard Bodine; Robert Sivells, 153 N. Greenwood Avenue.

ACTION:  This hearing was held in combination with hearing 08-24 and was continued to September 3, 2008, pending an appearance in front of the board by the paving contractor, James Piperato of J. Pips Paving.

 

08-26  8:00 p.m.  Geraldine Butz, 3550 Rocky Lane, located in a low density residential zoning district, is seeking a special exception pursuant to section 190-29 C, to operate a sewing business as a home occupation.

WITNESSES:  Geraldine Butz.

ACTION:  A motion was made by Cherie Kavanaugh to grant this special exception as a home occupation with no exterior sign requested or granted.  The motion was seconded by Daniel Caravetta and all were is agreement.

 

08-27  8:10 p.m.  Brian E. Hawk, residing at 2119 Gruver Avenue, is seeking a special exception pursuant to section 190-38 B to operate a home occupation as an electrical contractor in a medium density residential zoning district.

WITNESSES:  Brian Hawk;  Claude Ruttan, owner, 724 S. Main Street, Stewartsville, NJ.

ACTION:  Daniel Caravetta made a motion to approve this special exception for a home occupation, with no exterior or vehicle signage and no material or equipment storage.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

08-28  8:20 p.m.  Kevin S. Grega, 2326 Northwood Avenue, is seeking a special exception pursuant to section 190-38 B to operate a technical sales agency as a home occupation in a medium density residential zoning district.

WITNESSES:  Kevin Grega.

ACTION:  Cherie Kavanaugh made a motion to grant this special exception for a home occupation with the conditions that there be only one outside non-resident employee and no exterior signage, as none was requested by the applicant.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

Having no further business to discuss, the hearing was adjourned.
