MINUTES OF ZONING HEARING
BOARD MEETING
The zoning hearing
board of
Cherie Kavanaugh made a motion to approve the minutes of the November 4, 2008, zoning hearings. The motion was seconded by Daniel Caravetta, with all in agreement.
Charles Roseberry, made a motion to approve by resolution, dated December 2, 2008, to appoint Nicholas Noel III, Esq. as zoning board solicitor for the year 2009. Daniel Caravetta seconded the motion and all were in agreement.

Michael and Leila Finelli,
190-166 A (1), (2), (3), (4), establishing the number of off-street parking spaces.
190-168 C (2), regulating aisle width.
190-168 D (5), setting distances between driveways and streets.
190-168 G (3), establishing parking setbacks from buildings.
190-168 H (2), requiring separation of parking spaces from any street.
190-170 A, requiring loading facilities.
190-251 B, 190-252 H, 190-254 A, 190-256 A & B (1), 190-258 A, all dealing with use, trash, streetscape, parking and land development requirements of the Route 248 Overlay zoning district.
WITNESSES: Michael Finelli; Joseph Golden, realtor from Weichert Realty offices at 3010 William Penn Highway; James Kenney, 2359 Lawnherst Avenue; Bob Brodt, 2202 Edgemore Avenue, caretaker for Jane Crandell, 2445 Lawnherst Avenue, also in attendance.
ACTION: Deliberations and motions were as follows:
1. Pursuant to sections 190-166 A (1),(2),(3), & (4), pertaining to the required number of parking spaces, Daniel Caravetta made a motion to grant relief and deem the eight parking spaces as depicted in exhibit A-2, dated 09/12/08, revised 11/11/08 as sufficient. The motion was seconded by Cherie Kavanaugh, with all in agreement.
2. The applicant originally sought relief from section 190-168 C (2), but was amended to section 190-168 D (1) (a) [1], requiring a two-way access driveway to be a minimum of 24 feet wide. Cherie Kavanaugh made a motion to grant relief from this requirement and accept the driveway width of 20 feet as depicted on exhibit A-2. The motion was seconded by Daniel Caravetta, with all in agreement.
3. Pursuant to section 190-168 D (5) requirements for a 10-foot separation between driveways and street, Daniel Caravetta made a motion to grant relief due to the fact that the substandard separations were preexisting conditions. The motion was seconded by Cherie Kavanaugh, with all in agreement.
4. Relief from the 10-foot parking setbacks from buildings as required by section 190-168 G (3), and depicted on exhibit A-2, was recommended on a motion by Cherie Kavanaugh and seconded by Daniel Caravetta, with all in favor.
5. Daniel Caravetta made a motion to grant relief from section 190-168 H (2) requirements for a 10-foot distance from parking areas to streets and accept the conditions as presented in exhibit A-2. The motion was seconded by Cherie Kavanaugh, with all in favor.
6. Cherie Kavanaugh made a motion to grant relief from the need for a loading area as required by section 190-170 A and the motion was seconded by Daniel Caravetta, with all in agreement.
7. Daniel Caravetta made a motion accepting that the use as presented is indeed a conditional use, and all other determinations as land developments pursuant to section 190-251 B, are to be forwarded to the planning commission and Board of Supervisors for recommendations and approvals. The motion was seconded by Cherie Kavanaugh, with all in agreement.
8. Cherie Kavanaugh made a motion that the requirements of section 190-252 H, trash dumpster screening are not applicable since no trash dumpster is not being provided. The motion was seconded by Daniel Caravetta, with all in agreement.
9. Daniel Caravetta made a motion that all determinations as to streetscape performance requirements of section 190-254 A, be forwarded to the planning commission and Board of Supervisors for recommendations and approvals. The motion was seconded by Cherie Kavanaugh, with all in agreement.
10. Cherie Kavanaugh made a motion to grant relief from section 190-256 A & B (1) requirements for interconnection of parking areas and parking area lighting, and accept the conditions as presented in exhibit A-2. The motion was seconded by Daniel Caravetta, with all in agreement.
11. Daniel Caravetta made a motion that all determinations for submission of land development plan requirements of section 190-258 A be forwarded to the planning commission and Board of Supervisors for recommendations and approvals. This motion was seconded by Cherie Kavanaugh, with all in agreement.
Having no further business to discuss, the hearing
was adjourned.
