MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, January 6, 2009, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance Nicholas Noel III, Esq., zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh, and Daniel Caravetta, board members, John A. Embardino, zoning officer, and court reporter Ted Rewak. 

 

Cherie Kavanaugh made a motion to appoint Charles Roseberry as zoning board chairman for year 2009.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

Cherie Kavanaugh made a motion to accept the minutes of the December 2, 2008, zoning hearings.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

09-01         7:30 p.m.  Christopher Speidel, 1109 Colmar Avenue, is seeking a special exception pursuant to section 190-38 B, to operate a landscaping business as a home occupation in a medium density zoning district.

WITNESSES:  Christopher Spiedel, Allen and Cynthia Graver, 3708 Freemansburg Avenue.

ACTION:  Cherie Kavanaugh made a motion to approve the special exception for a home occupation as a landscaping business on condition that the 16,000 pound GVW dump truck not be allowed in the neighborhood, that a 12-foot long utility trailer be allowed and no storage of materials be allowed on premise and since no signage was requested, none is given.  The motion was seconded by Daniel Caravetta, with all in agreement.

 

09-02         7:40 p.m.  Pamela Gilbert, residing at 2800 Jones Boulevard, located in a medium density residential zoning district, is seeking a special exception pursuant to section 190-38 B to operate a mobile pet grooming business as a home occupation.

WITNESSES:  Pamela Gilbert

ACTION:  A motion by Daniel Caravetta was made to approve and off-site dog grooming business as a home occupation with the conditions that no customers come to the premises and no signage is to be allowed on vehicles.  No on premise sign was requested and none given.  Cherie Kavanaugh seconded the motion and all were in agreement.

 

09-03         7:50 p.m.  Mitchell and Katherine Ricker, 1222 Williamson Street, located in a medium density residential zoning district, are seeking a variance from section 190-211 E (15) (a) [1] in order to erect a shed that would be in a required front yard of a through/corner lot.

WITNESSES:  Mitchell Ricker

ACTION:  Cherie Kavanaugh made a motion which was seconded by Daniel Caravetta to approve the placement of a shed in a front yard with the condition that the shed be placed a minimum of five feet on all sides, inside and existing fence.  All were in agreement.

 

09-04         8:00 p.m.  Dianne Capobianco, 301 Broadway, Bethlehem, PA, representing property owner, Josh Case Development Co. LLC, 5010 Harvey Road, Bethlehem, PA, is seeking relief form section 190-53 A pertaining to minimum lot areas, width, and depth requirements, in addition to relief from section 190-53 C (4) requirement for front yard setback in order to construct a single family home on an undersize lot at the northeast corner of the intersection of Grove Street and Kingwood Street.  The applicants are also seeking a special exception to build on this nonconforming lot pursuant to 190-199 C (2) and appropriate relief from setbacks required therein.  The premises are located in a high density residential zoning district.

WITNESSES:  Dianne Capobianco, Constantine Vasiliadis, Esq., Dr. Joseph Krutsick, owner.

ACTION:  At the request of the applicant, the hearing was continued to 2/3/09.
