The zoning hearing
board of
Cherie Kavanaugh made a motion to accept the minutes of the June 2, 2009, zoning hearings. The motion was seconded by Dan Caravetta, with all in agreement.
09-15 7:30 p.m. 201 Jonathan Drive, Nicholas J Felker is seeking a special exception to have a home occupation under section 190-29C. The home occupation would consist of gunsmithing and limited firearm sales by special order only, with no inventory being kept on site. This property is located in a Low Density Residential District.

Action: Dan Caravetta made a motion to deny the application in its entirety based on sections 190-208 D(4),(5),(7) and (8) as they relate to the approval of a Special Exception, and sections 190-211(10)(a)[1] and [7] as they relate to a Home Occupation approval. All of the sections are out of The Palmer Township Code. The motion was seconded by Cherie Kavanaugh with all in agreement.
09-16 7:40 p.m. 56 Sutton Rd, Thomas Sherman is seeking relief from section 190-33 C to have a lot depth that is less than one hundred and twenty feet. Relief is also being sought from section 190-33 G (1) to have a principle structure that is closer than thirty five feet to the rear property line. This property is located in a Low Density Residential District.

Action: Cherie Kavanaugh made a motion to grant the variance with the condition that the existing garage become part of the principal structure being built on the lot that’s being created. The motion was seconded by Dan Caravetta with all in agreement.

Action: Dan Carravetta made a motion to grant the variance to
expand the diner into the rear yard setback, with the condition that the
expansion may not exceed what was presented on exhibit A-2 at the time of the
hearing. The motion was seconded by Cherie Kavanaugh with all in agreement.
9-18 8:00 p.m. 2210 Corriere Rd, Joe, Pat, and Robert Rizzolino are seeking relief from section 190-191A and an interpretation of section 190-192C in order to have another business in the building were Palmer Nursery and Wood Naturally is located. This property is located in a Planned Industrial-Commercial District.
Witnesses: Joe Rizzolino, Owner, Dennis DeEsch, Esquire, Mindy Tomaro, Florist Shop Owner.
Action: Cherie Kavanaugh made a motion to grant a variance to allow another business within the building were Wood Naturally and Palmer Nursery is located. It was felt that a florist shop would fit the character of the other businesses within the building. The motion was seconded by Dan Carravetta with all in agreement.
9-19 8:10 p.m. 4080 William Penn Highway, Finegan Funeral Homes, 302 Heckman Street Phillipsburg, NJ 08865 is seeking relief from sections 190-210 B(37)(a) to have a Funeral Home on a lot that is less than one acre, section 190-210 B(37)(d) to have parking that is not to the rear of the building, section 190-268 C that limits parking along the side of the building that faces a public street to three spaces, section 190-194 C to have obstructions in the sight triangle, section 190-168 G (1) to have parking spaces closer than five feet to the property line, sections 190-168 G(2) and section 190-168G(4) regarding the fifteen foot setback from the future curb line of the future right of way line, section 190-194 D(1)(b) regarding the ten foot buffer along a residential district, section
190-265A (all subsections) regarding screening and buffer yard requirements, and section 190-266 regarding sidewalks. This property is located in a General Commercial District.

Action: Dan Carravetta made a motion to grant relief for the parking requirements as was shown on exhibit A-2 at the time of the hearing. A motion was also made that an adequate buffer be installed to shield abutting residential neighbors from car headlights and that any light spillover from the property be controlled so a nuisance is not created for the neighbors. Relief was also granted for the addition on the westerly side of the building that will be replacing a covered deck. The motions were seconded by Cherie Kavanaugh with all in favor.
Having no further business to discuss on July 7, 2009, the hearing was adjourned at 11:10 P.M., with deliberations on July 14, 2009 ending at 10:00 A.M.
