MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, August 4, 2009, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance Nicholas Noel III, Esq., zoning board solicitor, Charles Roseberry, board chairman, Cherie Kavanaugh board member, Dan Caravetta board member and Peg Kennedy alternate board member, James Raudenbush, zoning officer, and court reporter Karen Mengel. 

 

Cherie Kavanaugh made a motion to accept the minutes of the July 7, 2009, zoning hearings.  The motion was seconded by Dan Caravetta, with all in agreement.

 

09-20 7:30 p.m. 673 S. 25th Street, Horizon signs, LLC on behalf of Scottrade and Talley Sign Co. 1040 S West end Blvd, Quakertown, Pa 18951, is seeking a variance from section 190-184A(4)a, to add to the signage in the Palmer Town Center that is already in excess of the 200 Square Foot maximum. This property is located in a General Commercial District.

Witnesses: Kevan Price from Horizon Signs

Action: Dan Caravetta made a motion to grant the variance for a business sign for Scottrade. The sign will be installed to match what was depicted in exhibit A-4 at the time of the hearing, and a timer will be installed so the sign is turned off thirty minutes after the close of business. The motion was seconded by Cherie Kavanaugh with all in agreement.

 

09-21 7:40 p.m. 3700 William Penn Highway, William Koch of Spectrum of Floors LLC and 3700 LLC, is seeking relief from section190-191 A that allows only one principal use per lot in order to place a rehabilitation institute in their building. This property is located in a General Commercial District along the William Penn Overlay district.

Witnesses: William Koch, Spectrum of Floors and Mary Chicchi 1755 Deer Path Rd Easton, Pa 18040

Action: Cherie Kavanaugh made a motion to grant relief for a therapeutic massage business under the condition that sufficient parking is provided for the new business, and any signage will meet applicable Palmer Township Ordinances. The motion was seconded by Dan Caravetta with all in agreement.

 

09-22 7:50 p.m 2720 Cresmont Ave, William P Cavanaugh is seeking relief from section 190-29 C for a home occupation; in order operate a landscaping business that includes a storage trailer. This property is located in a Low Density Residential District.

Witnesses: William Cavanaugh

Action: Dan Carravetta made a motion to grant relief in order to operate a landscaping business and to keep a 10’ storage trailer that is used for the business, as long as there is no permanent signage on the trailer or the residence. The motion was seconded by Cherie Kavanaugh with all in agreement.


9-23 8:00 p.m. 629 S. 27th Street, James Campbell of JTS Plumbing, is seeking relief from section 190-199F (2) to change from one non-conforming use to another, in order to operate a plumbing business.  This property is located in a High Density Residential District.

Witnesses: Dave Colver, 3130 Old Carriage Dr., Representing James Campbell

Action: Cherie Kavanaugh made a motion to grant relief in order to change one non-conforming use to another. It was felt that a plumbing business would be consistent with the previous uses in that building. The motion was seconded by Dan Caravetta with all in agreement.

 

09-13 8:10 p.m. 90 Kunkle Dr.(Holiday Inn Express and Suites),Palmer Hotel LLC., is seeking a variance from section 190-179D to replace directional signs with new directional signs in excess of 4 square feet. The applicant also seeks relief from section 190-185B(4) to replace and expand an illuminated wall sign. Relief is also being sought from section 190-185B(6) to replace a free standing sign. Lastly, relief from section 190-161D(1) to have an internally illuminated sign that has a light background. This property is located in a Planned Office/Business District.

Witnesses: William Malkames, Esquire, Donald Klim,Holiday Inn Express Representative, Tracy Snell, Newton Engineering, Virginia Berger, Philadelphia Sign Company.

Action: A motion was made by Dan Carravetta to grant relief for all the signage that was presented at the time of the hearing. The motion was seconded by Cherie Kavanaugh with all in agreement.

 

Having no further business to discuss, the hearing was adjourned at 10:30p.m.
