MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, April 6, 2010, at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance Nicholas Noel III, Esq., Zoning Board Solicitor, Charles Roseberry, Board Chairman, Cherie Kavanaugh Board Member, Peg Kennedy Alternate Board Member substituting for Dan Caravetta Board Member, James Raudenbush, Zoning Officer, and Court Reporter Ted Rewak. 

 

Cherie Kavanaugh made a motion to accept the minutes of the February 2, 2010, zoning hearings.  The motion was seconded by Peg Kennedy, with all in agreement.

 

10-06 7:30 p.m. 6 Northridge Ct., N Pugliese Inc., 1072 Grand St, Phillipsburg, NJ 08865 is seeking a variance from section 190-168D(4) in order to have two driveways along one street on one lot that has less than fifty feet between them. This property is located in a Medium Density Residential Zoning District.

Witnesses: Nick Pugilese, Contractor, Eric Spooner, Owner, Diana Spooner, Owner, Carrie Spooner, Owner

Action: Cherie Kavanaugh made a motion to grant a variance in order to have a driveway with two connections on a street that have less than 50 feet between them. The motion was seconded by Peg Kennedy with all in agreement.  

 

10-07 7:40 p.m. 2604 Dearborn St., Boom-a-Rang Beverage Co. is seeking a special exception from section 190-187 F(2) in order to have an off premise sign located at the south western corner of Dearborn St. and 25th St.  This property is located in a General Commercial Zoning District.

Witnesses: Habuk Shumar, Owner

Action: Cherie Kavanaugh made a motion to deny the request for an off premise sign, stating that the applicant was not able to meet all of the off premise signage requirements listed in section 190-187F (2). The motion was seconded by Peg Kennedy with all in agreement.

 

10-05 7:50 p.m.  1230 Tatamy Rd., Tamara L Hammer, 163 Silo Circle Nazareth Pa 19064 is seeking a special exception in order to operate a Day-care Center in a Medium Density Residential Zoning District. Variances are being sought from sections 190-210 C (16)(c) in order to have a structure that is less than one hundred feet from a residential property line (the proposed structure would be approximately forty-nine feet from a residential property line), 190-210C(16) (f) in order to have in excess of the twenty child maximum allowed by ordinance (a maximum of eighty-one children is being proposed),and 190-C(16)(b) in order to have a play area that is closer than twenty-five feet from the rear lot line (the proposed play area would be five feet from the rear property line).

Action: The subject property is being purchased by short sale from the bank. At the request of the applicant the hearing was continued to gather more information on the sale of the property to have proper standing.

 

Having no further business to discuss, the hearing was adjourned at 8:45p.m.
