MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Tuesday, August 3, 2004 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Dan Caravetta, board chairman, Charles Roseberry and Cherie Kavanaugh, board members, John A. Embardino, zoning officer and court reporter Ted Rewak.  The media was not represented.

 

04-30 7:30 P.M.  Keplers Fuel Company, 2010 Maywood Street, is seeking use variances and setback and buffer yard relief from sections190-112, 190-113, 190-114, 190-116 F, and 190-194 D, to subdivide land for residential use in an LI zone.  This hearing is continued from July 7, 2004.

HEARING IS CONTINUED TO SEPTEMBER 8 AT THE REQUEST OF THE APPLICANT.

 

04-31 7:40 P.M.  Steven J. Inc, is seeking area, width and depth relief from sections 190-42 A (1), B and C to build a single family home on an undersize lot at 3340 Florian Street in an MDR district.

WITNESSES:  Steven Miga, Charles Massey 1501 Blair St., Russ Sottosanti 1600 Blair St., Vincent Civitella 3303 Glen Avenue.

A MOTION by Cherie Kavanaugh to approve construction of a single-family home on a 60 x 115 lot with all applicable side, rear and front yard setbacks to be met was seconded by Charles Roseberry, with all in favor.

 

04-32 7:50 P.M.  Joseph Rizzolino et al are seeking a special exception per section 190-199 F, to convert an existing non-conforming medical use to a non-conforming law office at 2505 Newburg Road in an LDR district.

WITNESSES:  Joseph Rizzolino, Nicholas Noel, Jerry Zimmer 3305 Marwood Lane, Earl Houser 3307 Marwood Lane.

Nick Noel recused himself and was substituted by Michael Shay Esq. To act as interim solicitor.

A MOTION by Charles Roseberry to approve the request as presented with any proposed signage to meet zoning requirements, was seconded by Cherie Kavanaugh with all in favor.

 

04-33 8:00 P.M.  Steve Wilson, 717 Stones Crossing Road, is seeking relief from section 190-211 E (a) [2] [a] [ii] to construct an addition to an existing garage that will exceed 800 square feet for an accessory structure in an MDR district.

WITNESSES: Steven Wilson, Sandy Wilson

A MOTION by Charles Roseberry to grant the relief requested with a condition that there be a maximum of one accessory building allowed on the lot in the future, was seconded by Cherie Kavanaugh, with all in favor.

 

04-34 8:10 P.M.  Maina Pawar, is seeking relief from total area and height requirements per sections 190-183.1 B (2) and 190-183 A, to erect a freestanding sign at Crown Plaza shopping complex at Corriere and Tatamy Roads located in Penn’s Grant PRD in an MDR district.

WITNESSES:  Maina Pawar, Maya Pawar

A MOTION by Cherie Kavanaugh to deny the request was seconded by Charles Roseberry, with all in agreement.

 

04-35 8:20 P.M.  Joanna Levy, 2703 Spring Garden Street is seeking a special exception to conduct a personal training business is a garage addition to the front of her home in an MDR district.

A MOTION by Charles Roseberry to approve the special exception with sufficient off-street parking for a total of 6 vehicles to be provided was seconded by Cherie Kavanaugh with all in favor.
