MINUTES OF ZONING HEARING ON WEDNESDAY, AUGUST 5, 2003

 

 

The Zoning Hearing Board of Palmer Township met on Tuesday, August 5, 2003, at 7:30 p.m. in the meeting room of the Palmer Memorial Library.  In attendance were Chairman, Dan Caravetta, board members, Charles Roseberry and Cherie Kavanaugh, John Embardino, zoning officer, Ted Rewak, court reporter, and solicitor, Maura McGuire.  Fred Walters, reporter from the Morning Call, represented the media. 

 

 

03-23 – 7:30 P.M. – Continuation of hearing for Barry and Barbara McCulllen, 2805 Eldridge St., for development of a nonconforming lot in a MDR zone.  Section 190.199.C.2.

 

WITNESSES: Barbara McCullen; Joe Piperato; Joe Manos; Tom Riper.

On a motion by Cherie Kavanaugh, second by Charles Roseberry, with Dan Caravetta opposing, the development of the non-conforming lot was denied by a 2 to 1 vote.

 

 

03-26 – 7:40 – P.M. - Oscar Azcona, 128 Ridgeline Lane, requesting a variance from Ordinance 190.53.E.1 that requires a 30’ setback to the rear property line to build a sunroom on the existing deck, HDR zone. 

WITNESSES:  Oscar Azcona; Jason Kuchta.

On a motion by Charles Roseberry second by Cherie Kavanaugh and all in agreement, the rear yard setback reduction to a distance of 22 feet as presented for an enclosed deck was approved.

 

03-27 – 7:50 P.M. – Douglas Henson, 120 Ridgeline Lane, requesting a variance from Ordinance 190.53.E.1 that requires a 30’ setback to the rear property line to build a sunroom to replace an existing deck in a MDR zone.

 

            WITNESSES:  Douglas Henson

On a motion by Cherie Kavanaugh, second by Charles Roseberry, and all in agreement, the rear yard setback reduction to a distance of 25’ 5” as presented for an enclosed deck was approved.

 

03-28 – 8:00 P.M. – Leta Fredricks, 325 Nulton Avenue, requesting a special exception or variances as required to separate two lots at this location.  Sections that may apply are 190.199.C.2.a thru d., 190.40.A, and 190.42.F.  This is a MDR district.

 

            WITNESSES:  Leta Fredricks; Iggy Markow; Attorney, Ted Lewis.

On a motion by Charles Roseberry, second by Cherie Kavanaugh, opposed by Dan Caravetta, the request for separation of two lots as presented was denied.

 

03-29 – 8:10 P.M. – First Baptist Church, represented by Attorney Paul Harak, 177 Greenwood Avenue, is requesting a special exception for a temporary structure, Ordinance 190.200.F.1, for use as a classroom annex for teaching youths.  This is a MDR zone.

 

WITNESSES:  Pastor Arthur Gilmore; Attorney, Paul Harak; Mr. Hammerstone of Hammerstone Trust, representing property owners at 2849 Green Pond Road.

On a motion by Cherie Kavanaugh, second by Charles Roseberry, with all in agreement, the special exception to place a temporary structure for the purpose of classrooms, on leased abutting property, was approved.

 

03-30 – 8:20 P.M. – First Baptist Church, represented by Attorney Paul Harak, 177 Greenwood Avenue, is requesting a use variance to construct a place of worship on a property on Tatamy Road owned by Rosalie Bloys, Tuckertown, NJ.  This is a PO/IP district.

 

            THE REQUEST FOR THIS VARIANCE WAS WITHDRAWN BY ATTORNEY HARAK.

 

03-31 – 8:30 P.M. – Glenmoor Realty, L.P., represented by J. B. Reilly, requesting variances to construct a sign at the active adult community at Van Buren and Corriere Road.  Sections that apply are l90.183.B.2 and 190.211.E.7.d.2. and 4., and 190.181., in a MDR zone.  The sign is on a wall and several walls will be built.

 

            WINESSES:  James McAleer; Attorney, J.P. Reilly.

On a motion by Charles Roseberry, second by Cherie Kavanaugh, agreed by all, the variance to construct the walls as presented was approved.  The second part of the motion by Charles Roseberry, second by Cherie Kavanaugh to reduce the signage on the wall to 30 square feet maximum was opposed by Dan Caravetta and the motion passed by a 2 to 1 vote restricting the maximum area of the sign to 30 square feet.
