MINUTES OF ZONING HEARING ON WEDNESDAY, SEPTEMBER 3, 2003
The Zoning Hearing Board of Palmer Township met on Wednesday September 3, 2003, at 7:30 p.m. in the meeting room of the Palmer Memorial Library. In attendance were Chairman, Dan Caravetta, board members, Charles Roseberry and Cherie Kavanaugh, John Embardino, zoning officer, Ted Rewak, court reporter, and solicitor, Maura McGuire.
03-32 7:30 P.M.
William Rissmiller, 2733 John Street, requesting a variance from 190-42 E (4)
and 190-42 F (1), front and side yard setback requirements to construct an addition
to their home in an MDR zone.
Witnesses: Teresa and William Rissmiller
Motion: By
Cherie Kavanaugh to permit an addition with a side yard of 8 minimum and a
front yard as requested, second by Charles Roseberry and granted by a 3-0 vote.

P.M. John Melhem, 3667 Mountainview Avenue, requesting a variance from
Ordinance 190.33 E (3) that requires a 40 setback to the front property line
along a local street to build an addition to his dwelling in a LDR zone.
The applicants
failed to appear for their hearing.
03-34- 7:50 P.M.
Mauro Cabell, 2 Lord Court, requesting a variance from 190-42 E (4),
requiring a 30 setback from front yard property line along a local street to
build an addition to his dwelling in an MDR zone.
Witnesses: Mauro and Maria Cabell
Motion: By Charles Roseberry to grant variance for
front yard setback as requested, second by Cherie Kavanaugh and granted by a
3-0 vote.
03-35- 8:00 P.M.
Irene Bottos, 255 Mercer Street, Phillipsburg, NJ, represented by Alyson,
LLC; Anthony Sortino jr. requesting a variance from 190-53 C (3) requiring a
40 setback from a collector road, and a special exception under 190-199 C (2)
(a), nonconforming lots of record for a lot designated as 649 Greenwood Avenue
in a MDR zone.

by Charles Roseberry and denied by a 3-0 vote.

Nicholas Pugliese, seeking multiple variances for relief of landscaping,
buffers, screening, aisle width, parking lot setback, sidewalk construction,
signage, and sight triangle at 3100 William Penn Highway. Sections 190-265, 190-195 & 195, 190-168
C, G, & I, 190-266 & 267, and 190-194 C (1) (d) [1] apply. This site is in an HDR zone with William
Penn Overlay regulations to apply.

requesting a variance from sections 190-267 A and B signs in an overlay
district for a nonconforming use in an HI zone

Motion: By Cherie Kavanaugh to approve all sign
requests but to relocate a menu board to the southeast corner of the structure,
second by Charles Roseberry and granted by a 3-0 vote.

P.M.- Atlantic Equity Van Buren Road LLC, requesting a variance from section
190-42 A (1) and C for lot area and depth at Fox Run Estates in an MDR zone.
Witnesses: Atty Daniel Cohen, Don Frederickson,
Jonathon Grabow, Brett Owings.
Motions: By Charles Roseberry (1) to accept lots
51-75 along northern easement, (2) to approve lot 2 depth reduction, (3) to
approve lots 17-23 reduction is area and a 20 rear yard setback, all second by
Cherie Kavanaugh and all granted by a 3-0 vote.
Having no
further business to discuss, the hearing was adjourned.
