MINUTES OF ZONING HEARING BOARD MEETING

 

The zoning hearing board of Palmer Township met on Wednesday, September 8, 2004 at 7:30 P.M. in the Palmer Memorial Library, One Weller Place, to hear the following appeals.  In attendance were Nick Noel III, zoning board solicitor, Dan Caravetta, board chairman, Charles Roseberry and Cherie Kavanaugh, board members, John A. Embardino, zoning officer and court reporter Ted Rewak.  The media was not represented.

 

 

 

04-30 7:30 P.M.  Keplers Fuel Company, 2010 Maywood Street, is seeking use variances and setback and buffer yard relief from sections190-112, 190-113, 190-114, 190-116 F, and 190-194 D, to subdivide land for residential use in an LI zone.  This hearing is continued from August 3, 2004.

WITNESSES:  Kevin McFadden, Thomas McFadden, Don Frederickson, Thomas Walters, Esq.

A motion was made by Cherie Kavanaugh to deny the variances as requested.  The motion was seconded by Charles Roseberry with all in favor.

 

04-36 7:40 P.M.  Joseph and Patricia Manos, 2890 Fischer Road, are seeking a variance from sections 190-42 F (2) and G (2) to keep a residential accessory structure less than 5 feet from side and rear property lines in an MDR district.

WITNESSES:  Joseph and Patrica Manos.

Chairman Dan Caravetta recused himself from this hearing due to a potential conflict.

A motion was made by Cherie  Kavanaugh and seconded by Charles Roseberry with all in agreement, to deny the setback variances as requested.  No justification for a hardship was presented.

 

04-37 7:50 P.M.  The Highlands of Glenmoor, L.P. is seeking a variance and special exception from setbacks and height requirements per sections 190-211 E (7) (d) [3] and [4] to construct a five-foot wall and seven-foot pier at the entrance to an active adult community on Corriere Road in an MDR district.

WITNESSES:  A motion was made by Charles Roseberry to approve the variance for setback and height requirements with a stipulation that the lights mounted on the piers shall have diffused or frosted covers to protect against glare.  The motion was seconded by Cherie Kavanaugh, with all in agreement.

 

04-38 8:00 P.M.  Ryan Homes/ NVR, Inc. 196 West Ashland Street, Doylestown, is seeking a special exception per section 190-200 F to install a temporary sales trailer at Fox Run Estates along Van Buren Road in an MDR district.

WITNESSES:  Mike Ciabattoni, Robert Fleuehr, Don Frederickson, Steven Buck, Esq.

A motion to approve the request as presented with the stipulation that a split rail type of fence be placed between the temporary parking area and Van Buren Road, was made by Charles Roseberry and seconded by Cherie Kavanaugh with all in agreement.


 

04-39 8:10 P.M.  Robert Hale Jr., 3201 Bridlepath Road, is seeking variance from section 190-211 E (15) (a) [2] [i] to build and accessory structure in excess of a 15 foot height requirement in an LDR district.

WITNESSES:  Robert Hale

Cherie Kavanaugh made a motion to approve the height variance stipulating that the only utility to be connected to the shed would be electrical power.  The motion was seconded by Charles Roseberry, with all in agreement.

 

 

04-40 8:20 P.M.  Brian Fritz, 2507 Newburg Road, is seeking a special exception from section 190-29 C, to conduct a lawn care business as a home occupation in his residence in an LDR district.

WITNESSES:  Brian Fritz.

Mr. Fritz withdrew his request stating that he has moved his mowing equipment to another location and would not be running any type of business from his residence.

 

Having no further business to discuss, the hearing was adjourned.
